Executive Summary:
This item requests adoption of an ordinance to dissolve the Wilmar Community Facilities District #4 (CFD #4) and also requests adoption of a resolution to determine that CFD #4 is not obligated to pay any outstanding debt and no longer authorized to levy any special tax and ordering recordation of an addendum to the Notice of Special Tax Lien. The ordinance was introduced at the March 12, 2024 Board meeting. Dissolution of CFD #4 is requested by the Gold Ridge Fire Protection District to formalize the change in services that resulted from the reorganization of this territory from County Service Area 40 to the Gold Ridge Fire Protection District that occurred in June 2023.
Discussion:
In March of 1997 the Board of Supervisors established the Wilmar Community Facilities District #4 (CFD #4) to levy a special tax to finance enhanced levels of fire protection services in County Service Area (CSA) 40-FS Wilmar; this tax was approved by the voters in June of 1997. Annually since 1997, the County has levied this special tax within the boundaries of CFD #4.
On June 21, 2023, the Sonoma County Local Agency Formation Commission (LAFCO) recorded the Certificate of Completion that detached the County Service Area (CSA) 40-FS Wilmar area, which was serviced by the Wilmar Volunteer Fire Company, from CSA 40 and annexed that territory into the Gold Ridge Fire Protection District as part of a reorganization (Reorganization). As a result of the Reorganization, CSA 40 no longer provides fire protection services to the Wilmar area. That territory is now serviced by the Gold Ridge Fire Protection District, and they have requested that the County dissolve CFD #4.
Staff requests the Board adopt the ordinance to dissolve CFD #4 upon making a finding that the CFD is not obligated to pay any outstanding and that the CFD has no authorization to levy any special tax. Upon dissolving CFD #4, the Board shall direct the Clerk of the Board to record an addendum to the Notice of Special Tax Lien.
