Executive Summary:
At the request of the Gold Ridge Fire Protection District and pursuant to Government Code section 53338.5, the Board of Supervisors, as the legislative body for the Wilmar Community Facilities District # 4 (CFD #4), may dissolve any existing Mello-Roos Community Facilities District it has created based upon making certain findings. This item requests adoption of a resolution introducing, reading the title of and waiving further reading of an ordinance to dissolve CFD #4. Dissolution of CFD #4 is requested to formalize the change in services that resulted from the reorganization of this territory from County Service Area 40 to the Gold Ridge Fire Protection District (FPD) that occurred in June 2023.
Discussion:
In March of 1997 the Board of Supervisors established the Wilmar Community Facilities District #4 (CFD #4) to levy a special tax to finance enhanced levels of fire protection services in County Service Area (CSA) 40-FS Wilmar; this tax was approved by the voters in June of 1997. CFD #4 was established under the Mello-Roos Community Facilities Act of 1982 (Govt. Code section 35111, et. seq.), which grants the authority of taxpayers to establish a special tax to provide additional funding to exclusively benefit an area. Annually since 1997, the County has levied this special tax of approximately $118,576.33/year within the boundaries of CFD #4. The tax was suspended beginning in FY 2023-24 in anticipation of this dissolution process and there is no CFD fund balance to dispose of.
On June 21, 2023, the Sonoma County Local Agency Formation Commission (LAFCO) recorded the Certificate of Completion that detached the CSA 40-FS Wilmar area, which was serviced by the Wilmar Volunteer Fire Company, from CSA 40 and annexed that territory into the Gold Ridge Fire Protection District (District) as part of a reorganization (Reorganization).
The District levies a district-wide special tax and therefore the CFD tax was suspended at the beginning of FY 2023-24. The District has now requested that the County dissolve CFD #4. A resolution from the Gold Ridge Fire Protection District formalizing this request is attached.
