Authorize Sonoma County Water Agency’s General Manager to execute an agreement with Stone Creek Environmental Consulting, LLC, in a form approved by County Counsel, for hazardous waste and environmental regulatory support services through January 31, 2024, in the not-to-exceed amount of $80,000.



Executive Summary:

Sonoma County Water Agency (Sonoma Water) is required to meet hazardous waste and environmental regulatory requirements pertaining to stormwater, wastewater, potable water, hazardous materials management, and air quality. To meet these requirements, Sonoma Water needs support services including assistance with permitting and compliance documentation.




The mission of Sonoma Water is to effectively manage the water resources in its care for the benefit of people and the environment through resource and environmental stewardship, technical innovation, and responsible fiscal management.


Sonoma Water provides services such as naturally filtered drinking water, flood protection, distribution of recycled water, recreational opportunities, and wastewater treatment.  In addition, Sonoma Water provides wholesale water supply to approximately 600,000 people in Marin and Sonoma counties.


Sonoma Water must meet the requirements of various state agencies, such as the Bay Area Air Quality Management District, Bay Area Regional Water Quality Control Board and the North Coast Regional Water Quality Control Board (Regional Water Boards), and the California Office of Emergency Services.


Title 40 of the Code of Federal Regulations, Part 112 requires facilities with an aggregate aboveground oil storage capacity greater than 1,320 gallons or a completely buried storage capacity greater than 42,000 gallons to have a Spill Prevention Control and Countermeasure (SPCC) Plan. SPCC requirements include routinely inspecting oil storage areas, training, and updating plans every five years.  Sonoma Water has six facilities that require the development of a SPCC. The facilities include water and wastewater facilities.


In addition, the California Health and Safety Code section 25501(m) requires applicable facilities to complete and submit a Hazardous Materials Business Plan (HMBP).  Sonoma Water has over 20 facilities that require the preparation of an HMBP. The facilities include water, wastewater, and administration facilities.


Sonoma Water is currently enrolled in California State Water Board General Order WQ-2014-0194 Statewide Permit for Drinking Water System Discharges. This permit regulates the discharge of potable water from activities for public drinking water systems for routine discharges such as utility line flushing and groundwater well development. The permit requires Sonoma Water to implement Best Management Practices (BMPs) during permitted discharges, conduct periodic monitoring, keep records of discharges, and submit annual reports.


To comply with these environmental regulatory requirements, Sonoma Water needs support services including assistance with the SPCC Plan and the HMBP, air quality permitting, and requirements for potable water discharges.



On February 8, 2021, Sonoma County Water Agency and its affiliated sanitation districts issued a Request for Statements of Qualifications to the following 15 firms:

The following criteria were used to evaluate each firm:

1)                     Thoroughness of statement of qualification

2)                     Professional qualifications and demonstrated ability to perform the work

3)                     Exceptions to agreement terms


All 14 firms above were selected for the list of qualified consultants. Based on the evaluations, Stone Creek Environmental Consulting, LLC (Consultant) was selected for the subject work because of its extensive knowledge of hazardous waste regulations and environmental regulatory requirements in California.


Sonoma Water may seek to amend or enter into subsequent agreement(s) with Board approval if required, relying upon this competitive selection process, after the preliminary or initial work is completed.



Under the proposed agreement, Consultant will provide support services to Sonoma Water for environmental regulatory compliance across multiple program areas including water quality, air quality; and hazardous materials management.


The cost of services will not exceed $80,000; the term end date is January 31, 2024.


The agreement includes two options for Sonoma Water to extend the term for a period of one year each by providing written notice to Consultant thirty days in advance of the expiration date of the amended agreement and of the first extension option.  The extension will be formalized in an amended agreement or amendment signed by Sonoma Water and Consultant.

The services performed under the proposed agreement help Sonoma Water comply with environmental regulatory requirements pertaining to water quality.  This ensures that Sonoma Water will continue to provide safe water supply to its customers and effectively manage the water resources in its care.

Narrative Explanation of Fiscal Impacts:

Budgeted amount of $80,000 is available from FY 2022/2023 appropriations for the Water Transmission O&M Fund ($40,000), and for the Sonoma County Sanitation District and Zone Funds ($40,000) for regulatory and permitting assistance.


No additional appropriation is required.
