B) Adopt a Resolution authorizing a Budget Adjustment to the Department of Transportation and Public Works FY 2022-23 Final Budget in the amount of $1,000,000 to appropriate necessary funding to reflect the financial commitments of the Agreement.

Executive Summary:
The Sonoma County Public Infrastructure Department, formerly Transportation and Public Works, is requesting the Board approve and authorize the Chair to execute a Cooperative Funding Agreement (Agreement) with the Sonoma County Transportation Authority (SCTA). If approved, the Agreement will provide at least $1,000,000 to the County to deliver the Mark West Springs Road Sidewalk Improvements Project (C21303).
Discussion:
Pursuant to the Strategic Implementation Plan and Measure M, SCTA and the County desire to enter into a Cooperative Funding Agreement to define a framework which will enable the two parties to work cooperatively in developing transportation improvements on Mark West Springs Road in order to provide a safe route to school for children and enhance pedestrian access to local business in the Mark West/ Wikiup neighborhoods.
The Larkfield area was severely impacted by the 2017 Tubbs Fire and this project will deliver a major infrastructure upgrade to the community as it continues to rebuild. The project provides new bike lanes and sidewalk on both sides of Mark West Springs Road between Old Redwood Highway and Ursuline Road. In addition to the new sidewalks and bike lanes which will serve nearby John B Riebli School, the project will include an overlay of Mark West Springs Road from Ursuline Road to Old Redwood Highway.
The construction contract was awarded under authority delegated to the Road Commissioner for this project to Granite Construction Company in August 2022. The amount of the contract award is $3,374,206, including a 10% contingency. If the Agreement is approved, SCTA will make available up to $1,000,000 in 2004 Traffic Relief Act for Sonoma County (Measure M) dollars to assist with this project. The balance of project costs will be funded by 2017 PG&E fire settlement funds earmarked for infrastructure improvements (Infrastructure Resiliency Investment Plan Tier 2).

Narrative Explanation of Fiscal Impacts:
Funding sources for this project include:
1. $1,000,000 from SCTA available through this agreement
2. $1,900,000 allocated from the District 4 PG&E Tier 2 Funds
3. $450,000 of 2022-23 Pavement Preservation Program funds originally programmed to overlay Mark West Springs Road from Ursuline Drive to Old Redwood Hwy.
4. If necessary, $24,206 from the County’s annual SB1 allocation to cover contingency costs.
Expenditures for this project were programmed into the FY 2022-23 Roads Capital Adopted Budget (11051-34010103). An additional $1,000,000 of revenue and expenditure appropriations will be added to the Adopted budget with approval of corresponding Budget Resolution.
