Executive Summary:
In order to ensure that no adverse impacts occur to the Zone’s wastewater collection and treatment facilities, the Environmental Impact Report (EIR) requires that Sutter’s Santa Rosa Medical Center expansion project offset 100% of its wastewater flow by reducing water use within the Zone. This reduction in water use would be accomplished via a water conservation retrofit program. This program will replace existing toilets and other water fixtures within the Zone with low flow devices at the applicant’s (Sutter’s) expense and thus offset the project’s projected wastewater discharge. Sutter approached Sonoma Water with a request to pay the cost for the existing offset program in order to offset the project’s projected wastewater discharge. The proposed agreement will meet Sutter’s mitigation requirements under the EIR.
Discussion:
In order to ensure that no adverse impacts occur to the Airport Larkfield-Wikiup Sanitation Zone’s (Zone) wastewater collection and treatment facilities, the Environmental Impact Report, prepared by Sutter West Bay Hospitals, a California corporation, doing business as Sutter Medical Center Santa Rosa (“Sutter”), requires the Sutter’s Santa Rosa Medical Center expansion project to offset 100% of its wastewater flow by reducing water use within the Zone. This reduction in water use would be accomplished via a water conservation retrofit program. This program will replace existing toilets and other water fixtures within the Zone with low flow devices at the applicant’s (Sutter’s) expense and thus offset the project’s projected wastewater discharge. Sutter approached Sonoma Water with a request to pay the cost for the existing offset program in order to offset the project’s projected wastewater discharge. The proposed agreement contains the following terms:
1. The offset program will pay for all discharges from the Sutter of Santa Rosa Medical Center expansion project by paying $513,579.13 for the installation of water conservation devices through Sonoma Water’s High-Efficiency Fixture Direct-Installation Program (HEFDIP). The payment will provide an offset of 558.15 Equivalent Single-Family Dwellings (Offset ESDs). Each Offset ESD is equivalent to the projected savings in discharge by the use of water conservation devices, and is estimated in the Environmental Impact Report at 33 gallons per day.
2. Sonoma Water, via the Airport Larkfield-Wikiup Sanitation Zone, will provide treatment for the project’s wastewater in exchange for Sutter’s paying for the HEFDIP.
3. Sutter will conduct daily flow measurements of actual discharge from their facilities for a period of three (3) years after completion of construction.
4. If actual discharge measurements are greater than 558.15 Offset ESDs, Sutter will be responsible for preparing a Technical Report identifying additional conservation measures that will decrease the total discharge to, or below, 558.15 total Offset ESDs, or pay for additional Offset ESDs at a rate stated in the Agreement.
5. After an evaluation period, if the $513.579.13 is found to have been an overpayment, Sutter will receive a credit. This credit will be to Sutter’s ongoing sewer service charges.
Under the proposed agreement, Sutter will evaluate the actual flows generated by the Hospital and received by the Zone during the period commencing upon the date the Certificate of Occupancy for the Hospital Expansion was issued and terminating on the date which is three years thereafter. Upon the expiration of the Evaluation Term, Sutter shall provide a written report of the Actual Hospital Flows during the Evaluation Term to Sonoma Water.
Sutter will also reimburse Sonoma Water for staff time and County Counsel time for preparation and review of this Amended and restated MOA, review of information and Reports, and other tasks associated with such preparation and review, including but not limited to, review of the sewer capacity study and sewer extension plans, water conservation information, administrative and legal time.
Separately from the obligations in this Amended and Restated MOA to pay the Offset Fees, Sutter is responsible for paying the standard connection fees generally applicable throughout the Sanitation Zone in accordance with Sanitation Zone requirements for the Project and shall comply with any other general Sanitation Zone requirements applicable at the time the Wastewater Service is provided or that become applicable during provision of Wastewater Service.
Sutter will be responsible for paying sewer service fees for the Project in accordance with procedures and requirements established by Sonoma Water for the Zone. Subject to Sutter complying with the requirements specified in this Amended and Restated MOA, Sonoma Water will be responsible for providing wastewater services to the Project.
Sutter and Sonoma Water have agreed to the terms of the agreement, but are still finalizing language. For this reason, Staff request a delegation of authority to the General Manager to finalize and execute the agreement.
