Executive Summary:
Regional Parks proposes the County of Sonoma to enter into a Revocable License Agreement with Harmony Union School District for the operations and maintenance of the Occidental Community Center for the period of September 13, 2022 through September 12, 2032 as necessary to meet the social needs of the community.
Discussion:
The Occidental Community Center(OCC) has provided a facility for after school care, education, social, sporting programs and community events since 1972. The facility is owned by Sonoma County Regional Parks, but since 1989 has been operated by a non-profit.
In late 2019, the long-standing operator of OCC was unable to continue operating the facility.
Soon thereafter, the Covid-19 pandemic restrictions and lack of an operator left the facility unavailable to provide space for these meaningful community programs and events.
Working with the Occidental Community, Regional Parks identified opportunities and benefits for the community and youth to have a locally, community engaged entity operate the OCC.
Harmony Union School District (HUSD) provides education from TK through 8th grade to the Town of Occidental residents and surrounding areas. It has been a fixture in the community for decades.
The logistics to operate the OCC for Regional Parks have been difficult due to the its
proximity to other major parks and staff reporting locations. HUSDs’ location is ideal with services that can be used at both the OCC and Harmony School.
HUSD proposes to provide services similar to the previous non-profit, while working with Regional Parks to increase enhance the infrastructure to further the scope of services and opportunities to for the community. Regional Parks’ will provide some capital improvements to the OCC while the day-to-day operations are managed by HUSD to the benefit of the community.
Regional Parks’ mission to create recreation and education opportunities closely aligns with that of HUSD and an operating agreement for the Occidental Community Center is mutually beneficial to both entities.
Pursuant to Government Code Section 26227, the Board of Supervisors may fund programs deemed by the Board to be necessary to meet the social needs of the population of the county, including but not limited to, the areas of health, law enforcement, public safety, rehabilitation, welfare, education, and legal services, and the needs of physically, mentally and financially handicapped persons and aged persons.
Section 26227 also allows the Board of Supervisors to make available to a public agency, nonprofit corporation, or nonprofit association any real property of the county which is not and, during the time of possession, will not be needed for county purposes, to be used to carry out such programs, upon terms and conditions determined by the Board of Supervisors to be in the best interests of the county and the general public.
Staff is recommending that the Board find that the proposed license with Harmony Union School District is necessary to meet the social needs of the community in the areas of health, public safety, welfare and education and that the property is not otherwise needed by the County for the term of the agreement.
The County and the District wish to create the agreement for ten years with an option to authorize the Director of Regional Parks to extend the agreement up to four years upon expiration of the initial term. The agreement can be canceled for any reason by either party with thirty days prior written notice.
