Executive Summary:

The resignation of Gina Belforte has created a vacancy on the Board of Zoning Adjustments/Planning Commission for District Three.  My office recommends that you approve the Appointment of Evan Wiig to the Board of Zoning Adjustments and Planning Commission serving the remainder of the coterminous term that began on September 13, 2021. (Third District)  Mr. Wiig was a resident of District Three until the recent redistricting adjusted the district boundaries and reallocated his residence to District One.  While Sections 2-78 and 2-79 of the Sonoma County Code impose a residency requirement for members of the Board of Zoning Adjustments and Planning Commission, for the reasons set forth in the accompanying resolution, County Counsel and my office find that appointment of Mr. Wiig to this seat is appropriate.

 

Discussion:

District appointees to the Board of Zoning Adjustments (BZA) and Planning Commission serve contiguous terms with their appointing authority.  Gina Belforte was appointed to her position on the BZA/Planning Commission effective September 13, 2021, with the expiration of that term being coterminous with the current term of the District Three Supervisor.  Ms. Belforte has served her resignation, creating a vacancy on the BZA/Planning Commission for District Three, and I recommend that the Board approve the appointment of Evan Wiig to fill the remainder of her term, which expires on January 8, 2025.

 

Mr. Wiig was a resident of District Three until the recent redistricting adjusted the district boundaries and reallocated his residence to District One.  While the applicable provisions of the Sonoma County Code imposes a residency requirement on members of the BZA/Planning Commission, in light of the recent redistricting process and a relevant Attorney General Opinion, the appointment of Mr. Wiig to fill the District Three seat on the Board of Zoning Adjustments is appropriate for the reasons more fully discussed for the reasons set forth in the accompanying resolution.
