Executive Summary:

The County has recently installed a guardrail system adjacent to the County-owned property located at 665 State Highway 1 in Bodega Bay. The guardrail is a safety measure designed to mitigate conditions on the highway curve and shoreline at the property. While the guardrail was installed in State highway right of way in accordance with an approved encroachment permit, the State of California (Caltrans) requires the County to enter into a Maintenance Agreement for the long-term maintenance and responsibilities as to the guardrail. The Agreement would require the County to maintain and be responsible for the guardrail system so long as the system remains in Caltrans’ right of way. 

 

Discussion:

In April 2021, your Board authorized acquisition of property located at 665 Highway 1 in Bodega Bay (the Property). The acquisition was part of a legal settlement with the previous owners (Farfan), for claims made related to the residential structure on the Property which was damaged by a Sheriff’s Deputy patrol car that crashed into the structure during a high-speed pursuit.

Demolition and removal of all structures were completed in May 2021. The Property is currently vacant and not being utilized by the County for any purpose. In order to mitigate for public safety and to best prevent vehicles from entering the shoreline Property, the County in June 2022 installed a Midwest Guardrail System (MGS) in the Highway 1 right of way owned by the State of California, Department of Transportation (Caltrans). The MGS is approximately 50 feet in length and on the eastern side of the property boundary, in the right of way easement area. All work was done pursuant to a right of way encroachment permit approved by Caltrans.

As required by the encroachment permit, the County must now enter into a “Landscape Maintenance Agreement” with Caltrans to provide for, among other things, future maintenance of the guardrail. Pursuant to Caltrans requirements, a Resolution from the Board delegating authority for the Agreement is required. General Services is requesting approval of a Resolution to delegate authority to the Director of General Services to execute the Agreement and undertake other measures related to managing the Agreement on an ongoing basis.

There are no immediate fiscal impacts as a result of this Board Action. Any needed repair or maintenance of the guardrail system will be performed by the Transportation and Public Works Road Maintenance division and reimbursed by the General Services Department.
