Executive Summary:

Sonoma County has two representatives on the Board of Commissioners of the California County Tobacco Securitization Agency Joint Powers Authority. This Resolution will amend the position titles of the two Sonoma County representatives.

 

Discussion:

The California County Tobacco Securitization Agency Joint Powers Authority (“Tobacco JPA”) was established in 2000 between and among Sonoma County and eight other counties with the purpose of streamlining operations and sharing expenses among the counties for the purpose of issuing municipal debt secured by the counties individual master settlement agreement (“MSA”) rights to collect damages resulting from the sale and use of tobacco products. Sonoma County has rights to a portion of the MSA funds and has issued debt through the Tobacco JPA secured by those rights.

 

Sonoma County has two representatives on the Board of Commissioners of the Authority Tobacco JPA.  The last resolution, 2014-0437, adopted October 22, 2014, appointed the Assistant Treasurer-Tax Collector and the Investment and Debt Manager to be these Commissioners. These job class titles have changed since the last resolution and are no longer sufficient to describe the County’s representatives. 

 

Additionally, one of the County representatives is in the job class titled Assistant Auditor-Controller-Treasurer-Tax Collector, which is a multi-allocation job class. The Auditor-Controller-Treasurer-Tax Collector (“ACTTC”) established the working title of Chief Deputy Investment Officer for the Assistant Auditor-Controller-Treasurer-Tax Collector position that serves on the Tobacco JPA in order to differentiate from other employees in this job class and avoid having to appoint this individual by name. The Chief Deputy Investment Officer also oversees treasury, investment, debt and deferred compensation operations.

 

The ACTTC is recommending that your Board adopt the attached resolution amending the position titles of the County’s representatives to be the Chief Deputy Investment Officer and the Investment and Debt Officer.

10-22-2014 Board of Supervisors approved Resolution #14-0437 appointing the Assistant Treasurer-Tax Collector and the Investment and Debt Manager as the Sonoma County representatives to the Tobacco JPA.

10-16-2012 Board of Supervisors approved Resolution #12-0488 appointing Jonathan Kadlec, Assistant Treasurer and the Treasury Manager as the Sonoma County representatives to the Tobacco JPA.

03-13-2007 Board of Supervisors approved Resolution #07-0169 appointing Robert Boitano, Assistant Treasurer and Jonathan Kadlec, Administrative Services Officer as the Sonoma County representatives to the Tobacco JPA.

10-24-2000 Board of Supervisors approved Resolution #00-1310 forming the Tobacco JPA, as well as the Sonoma County Securitization Corporation, and other related matters.

01-25-2000 Board of Supervisors approved Resolution #00-0066 approving and authorizing an agreement regarding the Memorandum of Understanding settling litigation against various manufacturers of tobacco products.
