A)                     Adopt a Resolution authorizing the Sonoma County Probation Department (CDCR) to enter into an agreement with, and to reimburse, the California Department of Corrections and Rehabilitation to provide youthful offender housing, education, care, treatment programming, and training in wildland firefighting skills at the Pine Grove Youth Conservation Camp (PGYCC).

B)                     Authorize the Chief Probation Officer to execute agreements with the California Department of Corrections and Rehabilitation for housing, education, care, treatment programming, and training in wildland firefighting skills for a term from July 1, 2022 through June 30, 2023 in a maximum estimated amount of $277,035.

Executive Summary:

The recommended action is to authorize the Chief Probation Officer to enter into an agreement with the California Department of Corrections and Rehabilitations (CDCR) to provide housing, education, care, treatment programming, and training at the Pine Grove Youth Conservation Camp (PGYCC) to Sonoma County youth referred to this facility, operated by CDCR, by the Juvenile or Criminal Court.  The agreement establishes the rate, scope, and terms for the County to reimburse CDCR for these services.  The total agreement costs for the term beginning from July 1, 2022 through June 30, 2023 is estimated at $277,035.  This agreement is required to permit CDCR to accept juveniles who are referred by the Court pursuant to the requirements of the Welfare and Institutions Code Section 1752.1, for housing, education, care, treatment programming and training.

Pursuant to the proposed agreement, the Sonoma County Probation Department will reimburse CDCR at a rate of two hundred fifty three dollars ($253) dollars per day/per juvenile attending the Pine Grove Youth Conservation Camp.  The total contract amount is $277,035 for the one-year agreement term, however the term of commitment served by an individual youth will be determined by the Court and may be less than a full year. At the end of the agreement term (June 30, 2023) the contract may be extended upon mutual agreement between CDCR and County.  If the actual costs exceed the contract limit, the County agrees to compensate CDCR at the daily rate of $253 per youth.   Included in this cost is the provision of routine medical, dental or mental health treatment and routine periodic medical examinations for the referred youth.  The cost does not include extraordinary healthcare expenses, medical transportation or related transportation costs, nor emergency medical or mental health treatment, which remain the County’s responsibility to pay.

 

Discussion:

The agreement presented here allows youthful offenders to be referred to the Pine Grove Youth Conservation Camp in Amador County, which is a state-local partnership, or other management arrangement, to train justice-involved youth in wildland firefighting skills.

The Division of Juvenile Justice (DJJ) maintains the Pine Grove Youth Conservation Camp (PGYCC) in Amador County.  It screens and accepts youth age 18 and older from other DJJ facilities, or as court-ordered.  On September 20, 2020, SB 823 was signed into law, which began the closure of the State’s Division of Juvenile Justice (DJJ).  As of July 1, 2021 intake at DJJ facilities ceased except for:  Pine Grove Youth Conservation Camp, or youth with transfer hearings; and youth having petitions filed to transfer them to the jurisdiction of the adult criminal court. 

Training is provided by CAL Fire and youth are certified to engage in wildland firefighting operations.  Fire crews from DJJ camps perform approximately 180,000 hours of fire suppression services in a “normal” year for the people of California.

Crews typically work in state and county parks performing stream clearance, wild land fire prevention tasks, and habitat restoration work.  During the fire season, youth crews are involved in wildland fire suppression throughout the state of California.  Crews are also assigned to flood control activities.  The major emphasis of the program is to provide youths with employable skills and to develop within them a strong emphasis on solid work habits.  In addition, youth receive leadership training within their crew structure.

Youth that have not obtained a high school diploma, passed an equivalency exam that is recognized by the California Department of Education, or completed a legally established program of completion from an accredited school will be enrolled in the facility’s high school. Special education and English Learner services are provided, as required.

Youth may also access post-secondary education programs and college opportunities are available at PGYCC.

This is an opportunity for youth with the qualifications and an interest in participating with Court approval.  Successful completion of this firefighting program is not a guarantee of employment but does offer vocation skills in a variety of settings.

Narrative Explanation of Fiscal Impacts:

Costs for youth to attend the Pine Grove Youth Conservation Camp are General Fund expenditures.  Annually, the Department includes appropriations for out-of-home placement costs that cannot be claimed under state and federal foster care funding, i.e. Division of Juvenile Justice (DJJ), gender responsive residential program run by San Mateo County Probation, etc. As the state has realigned DJJ youth to their respective counties, the Department has redirected those appropriations in FY 22-23 toward specialized programs like Pine Grove Youth Conservation Camp (PGYCC). In FY 15-16 the annual housing cost for DJJ youth was approximately $324,000. In FY 22-23 those costs are estimated to be less than $150,000, affording the Department the opportunity to enter into partnerships like this agreement with the CDCR for the PGYCC fire program. Based on current resident needs, the program will be used sparingly and it is not likely to result in three youth at any time at the PGYCC facility, however the contract capacity for up to three youth participants allows for that contingency.  Assuming the partnership is successful and the contract is renewed in 2023, the program costs will be included in future fiscal years.
