Executive Summary:
On May 12, 2020, the Board of Supervisors awarded a Professional Services Agreement (PSA) to PreScience Corporation for construction management services associated with the Wohler Road Bridge Replacement at Mark West Creek Project. The total not-to-exceed value of the agreement at the time of award (including 10% contingency) was $889,888.67. Since award of the agreement, approximately 90% of the project is completed, and the new bridge is currently open to vehicular traffic.
In order to complete the final construction and environmental phases of the project, the Department of Transportation and Public Works (TPW) is requesting the Board approve a First Amendment to the agreement with PreScience Corporation in the amount of $132,993.24. If approved, the new, not-to-exceed value of the Agreement would be $1,022,881.91 with a term ending December 31, 2022. The amount of the increase exceeds delegated department head authority for amendments to construction-related services agreements and requires approval of the Board of Supervisors.
Discussion:
The Wohler Road Bridge at Mark West Creek Project (“Project”) replaces a structurally deficient bridge that does not meet current seismic standards. The new structure is a two-lane bridge which meets current Caltrans design standards and includes improvements to roadway approaches and shoulders. On April 21, 2020, the Board approved plans for the new bridge and awarded a $5,122,475 construction contract to Steelhead Constructors. On May 12, 2020, the Board of Supervisors awarded a PSA to PreScience Corporation for construction management services with a base amount of $808,989.70 and a 10% contingency of $80,898.97.
With construction and construction management contracts awarded, Project construction began in June 2020 and was scheduled to be completed by December 31, 2021. However, during the 2020 construction season the Project experienced delays related to the Walbridge Fire and a statewide cement shortage. During the 2021 construction season, the Project was delayed by the October 24, 2021 storm event during which Wohler Road and the new bridge were under flood waters for five days. Continued rains in November and December prevented construction completion in 2021. During the 2020 and 2021 construction seasons, there were 202 calendar days of delay that were unanticipated and unavoidable. The delays have extended the Project duration into a third construction season.
In June 2022, construction will resume in conformance with the Project’s environmental permitting. The remaining work includes removal of the old bridge abutments, final grading of the creek banks and roadside ditches, completion of barrier railings, and installation of permanent erosion control measures. In order to continue management of the construction contract during this third construction season, TPW is requesting approval of an amendment to PreScience’s professional service agreement for an increase in contract value of $132,993.24, for a new, not-to-exceed total of $1,022,881.91.

Narrative Explanation of Fiscal Impacts:
Expenses for this contract are included in the FY 2022-23 Roads Capital (11051-34010103) budget. Expenses are eligible for 100% reimbursement through the Federal Highway Bridge Program and corresponding revenues have also been included in the FY 2022-23 Roads Capital budget.
