Executive Summary:

On April 20, 2021, the Board of Supervisors awarded a construction contract to Team Ghilotti, Inc. to repair two locations on Cazadero Highway damaged in the January 2017 storm event. The total not-to-exceed value of the contract at time of award was $1,877,855 which included a 10% contingency. Since award of the contract, construction of one site has been completed. Work at the second site was suspended in the fall 2021 in order to comply with the environmental permitting. Work is scheduled to resume in summer 2022.

In order to complete construction of the second site this summer, the Department of Transportation and Public Works (TPW) is requesting the Board approve an increase in construction contingency for the contract by $85,000, for a new, not-to-exceed value of $1,962,855.

 

Discussion:

Cazadero Highway was damaged at multiple locations by debris flows and landslides directly related to the January 2017 storm event. The Cazadero Highway Storm Damage Repair Project, (C11650, C11602), is intended to repair two sites damaged during these storms. The project consists of construction of retaining wall structures, pile installation, roadway repairs, drainage repair and improvements concrete work, and asphalt concrete paving, which will increase the useful life of the roadway and better serve the public.

On April 20, 2021, the Board of Supervisors approved plans and awarded a construction contract to Team Ghilotti, Inc. to repair two locations damaged by the January 2017 storm event. The awarded contract included a base amount of $1,707,141, and a 10% contingency of $170,714 ($1,877,855 total).  During the course of construction, TPW staff has approved four construction change orders and four quantity adjustments within delegated Department authority. These changes resulted in a net increase to the contract value of $137,066.41 leaving $33,647.69 in contingency available to complete construction of the second location.

TPW approved change orders and quantity adjustments to date have improved site drainage, increased water pollution control monitoring, augmented paving, and improved public safety with the installation of a temporary traffic signal.  In addition, TPW has reached tentative agreement with the contractor for work already performed regarding differing site conditions (extremely hard rock drilling). The $77,000 agreement exceeds the remaining available contingency amount approved by the Board on April 20, 2021. TPW staff is requesting Board approval of an increase in the contract contingency of $85,000 for a new, not-to-exceed value of $1,962,855. If approved, the increased contingency will fund the agreement for differing site conditions, facilitate completion of the second storm damage site, and address any remaining unforeseen expenses.

Narrative Explanation of Fiscal Impacts:

Appropriations for the requested increase in the contract contingency amount is included in the TPW FY 2022-23 Capital Improvement budget (11051-34010103). Of the requested $85,000 increase, $63,750 (75%) is eligible for reimbursement from FEMA, and an additional $15,937.50 (18.75%) is eligible for reimbursement from California Governor’s Office of Emergency Services (CalOES). The remaining balance of the increased contingency costs ($5,312.50) will be paid from SB1 funds allocated to the Roads Division Capital Improvements Section.
