C) Authorize the General Manager of the Sonoma County Water Agency to sign Section 00 65 23 (Agreement and Release of Any and All Claims), with County Counsel review, if any unresolved claims are listed by the contractor.
D) Adopt a Resolution Authorizing Adjustments to the Board Adopted Budget for Fiscal Year 2021-2022 for the Common Facilities Fund in the amount of $200,000.

Executive Summary:
This item requests approval of a contract with Bouthillier’s Construction, Inc. for $282,303 for construction of Wohler Access Road Retaining Wall to halt a creeping landslide on the access road to the Wohler production facilities and to repair the roadway surface.
A portion of the embankment along the primary route to the water production facilities at the Wohler Plant is failing and requires repair. All-weather, continuous access to the Wohler Plant is essential. Sonoma Water completed this design to mitigate landslide impacts to the roadway and maintain access to these critical facilities. This project will install a 90-foot long retaining wall to stabilize the access road and further mitigate the creeping landslide.
Discussion:
HISTORY OF ITEM/BACKGROUND:
Shortly after construction of the aqueduct serving Wohler Collector No. 6, cracks began appearing in the primary paved access road leading to the Wohler production facilities. The access road is on the side of the hill just east of the Russian River and north of Wohler Bridge. The cracks in the pavement indicate potential of a creeping landslide under the roadway.
In 2003, Sonoma Water excavated a test pit and a geotechnical consultant concluded that the fill and natural soils had begun to fail over the bedrock. In the years since the cracking was first noticed, ongoing monitoring of the roadway surface revealed little to no apparent additional movement of the slope over the years. While there has been no immediate urgency to mitigate the problem, adding a retaining wall was identified as a capital project to support the road and reduce the risk of catastrophic failure in the future.
Geotechnical services for the geotechnical portion of the project were provided by Kleinfelder Inc. under an existing as-needed professional services agreement. Geotechnical recommendations were incorporated into the staff design of the bidding documents.
The Project consists of construction of the Wohler Access Road Retaining Wall located at 9750 Wohler Rd, Healdsburg, CA 95448 in an unincorporated area of Forestville, Sonoma County, California. The work includes, but is not limited to, the construction of 90 feet of soldier-beam retaining wall, drilling and embedding soldier piles with a length of 35.5 feet, and providing wood lagging and backfill. The work also includes approximately 135 square yards of asphalt-cement overlay with leveling course. The work shall be completed within 193 Days from the date when Contract Time commences to run.

The lowest responsive and responsible bid is from Bouthillier’s Construction Inc. and is $67,697 below the Engineer’s Estimate. Bouthillier’s Construction Inc. is experienced in this type of construction and met the experience requirements.
A contractor must execute a release of claims (Section 00 65 23) before final payment but may except any unresolved claims from the release. The requested action authorizes the General Manager to approve the release unless the contractor lists unresolved claims. In that case, County Counsel must review Section 00 65 23 prior to General Manager approval.
Construction on the Project is approximately scheduled to begin June 2022, with an estimated substantial completion date by November 2022.

Budgeted amount of $82,303 is available from FY 2021/2022 appropriations for the Common Facilities Fund. Additional appropriations in the amount $200,000 from the Common Facilities Fund are required to process this expense. A budgetary resolution has been submitted with this item.
