Approve and authorize the Chair to execute amendments to master agreements with two consultants for On Call Right-of-Way Services in order to extend the agreements for twelve months.

Executive Summary:

The Department of Transportation and Public Works (TPW) is requesting that the Board approve two amendments for twelve-month time extensions to master agreements for On Call Right-of-Way Services. The proposed amendments will enable completion of work initiated during the original contract period with no increase to the previously approved, not-to-exceed values.

 

Discussion:

On December 4, 2018, the Board approved master agreements for On Call Right-of-Way Services with five consultants. Two master agreements were issued to each consultant: one for work on local, State, and FHWA funded work; and one for projects funded by FEMA. These on call consultant contracts have increased TPW’s capacity to bring multiple projects to construction over the last three years including: the Little Wohler Bridge Replacement Project, the Watmaugh Road Bridge Replacement Project, and several FEMA-funded disaster recovery projects.

Five of the projects initiated during the three-year contract period are not completed and TPW is requesting Board approval to extend those agreements, with Associated Right of Way Services (AWRS) and Overland, Pacific, and Cutler (OPC), by one year. The time extensions will enable the consultants to complete their work on the existing projects, preventing time delays or additional costs. These time extensions will only be used for the completion of work already underway on the aforementioned projects. New construction projects will utilize newly established Right-of-Way contracts scheduled to be approved by the Board of Supervisors on December 7, 2021.

The impact of not approving these no-cost time extensions would be an immediate halt to work on five federally-funded projects (FHWA/FEMA) that are under strict progress and completion timelines. Failure to meet these timelines could result in either a loss of funds and/or a requirement to return already reimbursed costs.

There are no direct fiscal impacts connected with this Item as the Department is only requesting a time extension for contracts previously approved by the Board. Expenses associated with work covered by these Agreements and related Task Orders have been included in the FY 2021-22 Roads Capital adopted budget.
