Executive Summary:

The canvass for the September 14, 2021, California Gubernatorial Recall Election, has been completed and certified by the County Clerk. The Clerk is now submitting the official canvass to the Board of Supervisors (BOS) for adoption as provided by law.

 

Discussion:

Pursuant to California Elections Code (EC) §§1003(e) and 11240, on May 25, 2021, the Sonoma County BOS ordered an election be held on September 14, 2021, to determine whether District Attorney Jill Ravitch shall be recalled, and if a majority votes in favor of the recall, to elect a successor.

 

On June 8, 2021, pursuant to EC §§11003(e) and 9241, the Rohnert Park City Council ordered a special election on September 14, 2021, so voters could decide whether or not to approve an ordinance banning the use and sale of fireworks, as well as requested consolidation with the September 14, 2021, District Attorney Recall Election.

 

On July 1, 2021, pursuant to Sections 15 and 17 of Article II of the California Constitution, Lieutenant Governor Eleni Kounalakis issued a proclamation ordering a special statewide election to be held on September 14, 2021, to determine whether Governor Gavin Newsom shall be recalled, and if a majority votes in favor of the recall, to elect a successor.

 

On July 6, 2021, pursuant to EC §§1605(f) (a new provision of the EC added by urgency legislation [SB 152] and signed into law by Governor Newsom on June 28, 2021) and 10400, the Sonoma County BOS authorized the consolidation of any election already scheduled for September 14, 2021 (District Attorney recall and City of Rohnert Park fireworks referendum) with the California Gubernatorial Recall Election that had been scheduled for the same date.

 

EC §15372 provides that the elections official (the County Clerk) shall canvass the returns, prepare a certified statement of the results of the election, and submit the statement to the appropriate governing bodies. EC §15400 further states that the governing bodies in turn shall declare the results of each election under its jurisdiction. In this election, the certified results of Measure D are being transmitted to the Rohnert Park City Council for adoption and the certified results of the gubernatorial recall are being transmitted to the California Secretary of State’s Office for adoption.  Similarly, the certified results of the District Attorney Recall are being transmitted to the BOS for adoption through this Board item and resolution.

 

Prior Board Actions:

                     On July 6, 2021, the BOS -- in a special emergency session -- adopted a resolution authorizing consolidation of any local elections called for September 14, 2021, by governing bodies that have submitted requests for consolidation (as required by EC §§10400-10401) with the California Gubernatorial Recall Election taking place on September 14, 2021 (as permitted by EC §1605(f)) (Resolution 21-0271).

                     On May 25, 2021, the BOS adopted a resolution calling for a special election to take place on September 14, 2021, so voters could decide whether to recall District Attorney Jill Ravitch, as well as who would replace her if a majority voted in favor of the recall (Resolution 21-0220).

                     On May 18, 2021, the BOS accepted the certificate of sufficiency to recall District Attorney Jill Ravitch.
