Executive Summary:
An election is scheduled for November 2, 2021, to elect directors to various special districts. In those districts in which the number of nominees was equal to or less than the number of seats to be filled, Elections Code §10515 provides for appointment of the nominees by the supervising authority (Board of Supervisors) rather than requiring an election.
Discussion:
The attached resolution includes the names of the candidates who qualified for appointment to their respective districts pursuant to the above-stated provision of state law. The resolution also certifies that no petition has been submitted to the Registrar of Voters requesting a general election for these districts. Accordingly, Elections Code §10515 requires that these appointments be made by the Board of Supervisors, as the supervising authority. The appointments shall be made prior to “the Monday before the first Friday in December in which the election is held.” For the November 2, 2021 Consolidated General Election, this date is November 29, 2021. Each person so appointed shall qualify, take office, and serve exactly as if elected at a general district election for such office.
For those offices for which no candidates filed or fewer candidates filed than the number of seats to be filled, the law provides that the Board of Supervisors, as the supervising authority, appoint any person who is qualified to hold each office as of November 2, 2021. Separate memos to the Clerk of the Board and to the Supervisors will list the vacant positions and the necessary qualifications for appointment. It will be incumbent upon the Board to identify qualified candidates and make the necessary appointments to fill the vacant seats.
Upon adoption of this resolution, the Registrar of Voters Office will issue certificates of election to the respective nominees.

On September 15, 2020, the Board of Supervisors authorized appointment of directors in districts with insufficient nominees for the November 3, 2020, Consolidated General Election (Resolution 20-0339).
