Executive Summary:
Staff is recommending the approval of plans and specifications for the Hot Springs Road, Cherry Creek Road, and Mill Creek Road Storm Damage Repair projects and associated award of a construction contract to the lowest responsible bidder for the combined project work. As part of this project, staff is recommending a 10% construction contingency of $536,369 to account for unforeseen existing conditions. Construction contract costs are eligible for grant reimbursements through the Federal Emergency Management Agency (FEMA) and California Department of Emergency Services (CalOES).
Discussion:
Hot Springs Road, Cherry Creek Road, and Mill Creek Road were damaged by debris flow and landslides directly related to the storms of January and February 2017. The slide repairs will include improvements to the roadways in addition to the installation of retaining walls. The replacement sections of the roads will comply with applicable roadway and drainage standards to accommodate future storm events such that the sections of roads will not fail again under similar circumstances.
The included contract will accomplish installation of the new retaining walls.
Request For Bids/Construction Documents along with associated advertising took place on July 16, 2021.

Bids were received and deemed responsive as follows:

The Engineer's Estimate was $6,900,000
In accordance with Public Contract Code Section 20128, the contract shall be awarded to the lowest responsible bidder. The first apparent low bidder for this work is Rege Construction, Inc. However, Rege Construction, Inc requested, and was granted bid relief due to bidding error and as required by applicable law. The next lowest bidder is Argonaut Constructors. The Department recommends awarding the contract to Argonaut Constructors who was determined to be the lowest responsible bidder for this project.
The total, not to exceed cost of construction is estimated at $5,900,062 including 10% for construction contingency. Appropriations are available in the FY 2021-22 budget. Argonaut Constructors is experienced in this type of work. They have been licensed since 1957.
The Board may elect to not award this contract. However, doing so would leave this section of road unrepaired, and could jeopardize FEMA reimbursement for the project. In addition, these portions of the subject roads are County maintained roadways so not conducting repairs could lead to liabilities regarding public access and/or conditions.

Narrative Explanation of Fiscal Impacts:
Appropriations for this this contract are programmed into the FY 2021-22 Transportation and Public Works Roads Capital Improvement budget (11051-34010103). Of the contract total, $4,425,047 (75%) is eligible for reimbursement from FEMA, and an additional $1,106,262 (18.75%) is eligible for reimbursement from California Governor’s Office of Emergency Services (CalOES). The remaining balance of the project costs ($368,753) will be paid from SB1 funds allocated to the Roads Division Capital Improvements Section.
