Adopt a resolution accepting an “Irrevocable Offer of Dedication” granting a perpetual right to County of Sonoma to accept a public trail easement for recreation and non-motorized transportation over property located in the Mark West Creek Watershed.

Executive Summary:

A landowner located in the Mark West Creek watershed desires to donate a perpetual Irrevocable Offer of Dedication of a public trail easement for recreation and non-motorized transportation across property located at 2577 Calistoga Road, Santa Rosa, CA, Assessor’s Parcel Number 028-100-024 (“OTD”).  This Offer is made pursuant to Government Code Section 7050, and gives the County the right to accept the OTD at any time in the future, in the event it is desirable to locate a trail in this area of the County.  There are no current plans to locate a public trail in this area, however, the landowner, LandPaths, a non-profit land conservation organization, with a core mission of connecting people to the land, desires to donate this OTD to the County, at no cost, in the event the County’s trail system grows in the future.

 

Discussion:

LandPaths, a non-profit land conservation organization, approached Regional Parks and offered to donate the OTD.  Regional Parks reviewed the property, conducted due diligence, and determined that the OTD may be beneficial to the County in the future.  At this time, there are no plans for a public trail system in this area of the County; however, it is possible that an expanded trail system could be desirable in the future.  Given that this is a donated OTD, Regional Parks recommends that the County consent to the OTD, and reserves recommending its exercise until an appropriate time in the future.  Authority is sought from the Board of Supervisors to consent to this donated Irrevocable Offer of Dedication and to record the document.

 

CEQA:

 

Acceptance of an offer of dedication does not have a potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and is not a project.  Even if a project, this action is statutorily exempt from CEQA review as acquisition of land for park purposes - preserving both habitat and recreational options.
