Executive Summary:
Sonoma County requires that an application for a permit, known as a roiling permit, be filed with the Board of Supervisors prior to work or operations in a river, stream, or channel which may decrease the clarity of these waterways. The recommended resolution will issue a roiling permit to Sonoma County Regional Parks for construction to take place between 07 September and 31 October 2021. Permit and permit extensions for work within a channel or stream must be approved by the Board of Supervisors.
Discussion:
In 2004, your Board approved a Master Plan for three phases of park improvements at Guerneville River Park. The goal of the overall park improvement plan is to link the west and east sides into one unified park, and provide enhanced public access to the Russian River. This overall project was approved by your Board in 2004.
The limited action before your Board today is the latest step to accomplish Phase Two of that overall Guerneville River Park Master Plan. This portion of the project is limited to the construction of a concrete non-motorized small-craft hand-launch boat ramp. The concrete boat ramp includes associated rock slope protection. Installation of the boat ramp includes excavating, grading and bank stabilization. The boat ramp will be constructed along approximately 200 linear feet of the south bank of the Russian River at a gradual slope running along the bank, impacting 2,062 square feet. Approximately 9,834 square feet of riprap will be installed and will be interplanted with willow stakes. The total permanent impact will be approximately 11,896 square feet of the riverbank, and will include approximately 1,681 cubic yards of riprap, 47 cubic yards of concrete, and 36 cubic yards of concrete base rock. The total temporary impact will be approximately 20,000 square feet. Approximately 35 trees will be removed as part of the project. As part of restoration to compensate for project impacts, approximately 102 native trees, 39 native understory plants, and 279 willow poles will be planted on site. No in-water work will be required; however, groundwater management will be required.
This portion of the project requires that an application for a permit be filed with the Board of Supervisors prior to the performance of certain prescribed work or operations in a river, stream or channel which may decrease the clarity of these waterways. (Section VIII of Ordinance No. 3836R “Roiling Permit Ordinance”).
Applications for roiling permits must describe the work or operations to be done, in detail, including expected impacts on the clarity of the river and any proposed monitoring or mitigation measures to avoid unreasonably decreasing the clarity of the river, the purpose of the work or operations, the manner in which the work or operations will be carried out, and the time within which the work or operations will be completed. A site plan showing the exact location of the proposed work is also required. The application submitted by Sonoma County Regional Parks complies with the requirements of the Roiling Permit Ordinance. The applicant represents that no significant residual impacts affecting water clarity of the Russian River will result. The applicant proposed to construct a concrete non-motorized small craft hand launch boat ramp. The work is proposed to commence no earlier than September 7, 2021 and is scheduled to be completed by October 31, 2021.
In addition, applications must be accompanied by a copy of the agreement required by Section 1601 et seq. of the California Fish and Wildlife Code and water discharge permits applicable to the work or operations, if any, pursuant to the Porter-Cologne Water Quality Control Act. Applicant has done so. As demonstrated in the attachments to this Board item, the applicant has received approvals and environmental review from the U.S. Army Corps of Engineers, the Department of Fish and Wildlife and the North Coast Regional Water Quality Control Board. In addition, when the overall Master Plan was approved by the Board of Supervisors, the County obtained a certified Mitigated Negative Declaration for this project in compliance with the California Environmental Quality Act.
As described in the application and demonstrated in practice in previous permitting periods, the work will likely require greater than 30 days to complete. To accomplish this, the permit may be extended for additional 30- day periods if such permit period extensions are approved by the Board of Supervisors as requested in this agenda item. The Director of the Permit and Resource Management Department shall confirm the need for each permit extension immediately prior to the expiration of the current permit period to ensure that the work is not yet complete and an additional 30-day period extension is necessary. Four 30-day extensions may be required.
Pursuant to the Roiling Permit Ordinance, roiling permits and extensions require a 4/5 approval vote by the Board according to the requirements of the 1988 ballot measure creating the Roiling Permit Ordinance.
