A)                     Approve Resolution authorizing the Director of Department of Transportation and Public Works to execute an Amendment of Lease No. PRC 9166.9 with the State of California State Lands Commission, and all other necessary documents as approved by County Counsel, for additional State lands and waters needed for use, maintenance, repair, and construction of the Big Wohler Road Bridge over the Russian River.

B)                     Ratify and otherwise approve Lease No. PRC 9166.9 between County and the State of California State Lands Commission, for State lands and waters needed for use, maintenance, repair, and construction of the Big Wohler Road Bridge over the Russian River, retroactive to and effective as of December 17, 2014.

Executive Summary:

The Department of Transportation and Public Works (TPW) is requesting the Board of Supervisors approve a resolution for, and authorize the Director to execute an Amendment of Lease No. PRC 9166.9 with the State of California State Lands Commission.

The project is required as part of Sonoma County’s program to retrofit bridges requiring seismic restoration in the County. Project construction on the Wohler Road Bridge over the Russian River (commonly referred to as the “Big Wohler Bridge”) is expected to begin in spring of 2022. To allow for bridge construction and maintenance activities, the Lease and an expanded lease area is needed. The subject Amendment provides the needed rights and area at no charge to the County, as no rent or other monetary consideration is due from County under the Amendment or underlying Lease.

 

Discussion:

The County of Sonoma and the State of California, acting through the State Lands Commission, entered into an agreement designated as Lease No. PRC 9166.9 on December 17, 2014. The Lease was executed as part of a series of Big Wohler Bridge specific projects and agreements approved by your Board during that period of time.

Due to design modifications to the Wohler Road Bridge project in the time since the Lease was executed, additional areas are needed. The areas are subject to State Lands Commission jurisdiction. The proposed Amendment will expand the existing leased area over the Russian River from a width of 80 feet to a width of 200 feet in the vicinity of the Wohler Road Bridge. The additional width allows for adequate construction and maintenance areas for the modified bridge design.

The Amendment also provides for an additional insurance requirement, as requested by the State Lands Commission.

State Lands Commission requires a written Resolution from the County for approval and authority to enter into the subject Amendment for the lease of Commission-controlled state lands.

Narrative Explanation of Fiscal Impacts:

A processing fee in the amount of $2,500 was sent to the State Lands Commission in FY 2019-20. Those funds have applied to the administrative charges associated with processing this Amendment. No other fees or rent will be due under the Amendment or Lease and there are no fiscal impacts to the current fiscal year.
