Authorize Sonoma County Water Agency’s General Manager to execute the Second Amended Agreement for As-Needed Sediment Testing Laboratory Services in Support of Stream Maintenance Program with Eurofins Calscience, LLC, to provide sediment testing laboratory services.  The amended agreement extends the agreement term by two years at no additional cost for a new end date of June 30, 2022.

Executive Summary:

Sonoma County Water Agency (Sonoma Water) requires assistance with laboratory testing and reporting services for freshwater sediment samples collected in the Russian River, Petaluma River, and Sonoma Creek watersheds.  These efforts are in accordance with the State Water Resource Control Board’s Water Quality Control for Enclosed Bays and Estuaries (Part One: Sediment Quality).  This item requests approval of a second amended agreement for this purpose.

 

Discussion:

HISTORY OF ITEM/BACKGROUND

Sonoma Water maintains approximately 75 miles of flood control channels in Sonoma County.  Sonoma Water’s Stream Maintenance Program permits from the San Francisco Bay and North Coast Regional Water Quality Control Boards require testing sediments for specific analytes when conducting certain sediment removal activities within flood control channels.

 

Sediment samples must be sent to a qualified laboratory for chemistry and toxicology analysis as such as services are not provided by Sonoma Water or other county departments.

 

Sonoma Water and Eurifins Calscience, LLC (Consultant) entered into an agreement for sediment testing laboratory services, dated May 10, 2016 in the amount of $120,000, with a term end date of June 30, 2018.

 

On June 13, 2018, the agreement was amended to add two years to the agreement term at no additional cost to allow Consultant to continue the work. The new term end date was June 30, 2020.

 

SELECTION PROCESS

In February, 2016, Sonoma Water issued a Request for Statements of Qualifications to six firms. The Request for Statements of Qualifications was also posted on Sonoma Water and County of Sonoma Purchasing Department websites.

 

Four firms responded:

1.                     ALS Environmental, Simi Valley, CA

2.                     Eurofins Calscience, Inc., Garden Grove, CA

3.                     McCampbell Analytical, Inc., Pittsburg, CA

4.                     TestAmerica, Inc., University Park, IL. 

 

The following criteria was used to evaluate each firm:

1)                     Thoroughness of SOQ

2)                     Professional qualifications and demonstrated ability to perform the work

3)                     Exceptions to standard terms in the sample agreement

4)                     Submission of an example electronic data deliverable (EDD) in MS Excel database format of test results that would be submitted with final deliverables

 

Consultant was selected to perform the services due to its experience, facilities, instrumentation, personnel, capacity, and commitment to high quality data.  In addition, Consultant also has an excellent history of customer service and has shown the ability to meet needed deadlines.

 

SERVICES TO BE PERFORMED

Under the proposed amended agreement, consultant will continue to provide as-needed laboratory analysis of sediment samples using current or documented modifications of current United States Environmental Protection Agency methods.

 

The agreement includes two options for Sonoma Water to extend this agreement for a period of one year each by providing written notice to Consultant thirty days in advance of the expiration date of the agreement and of the first extension option.

 

There is no additional cost for the amended agreement.  The new end date is June 30, 2022.  Board approval is necessary for the extension because the revised term will exceed the maximum three-year limit on agreements signed by Department Heads.

02/26/2013:  Approved agreement between Sonoma Water and Colombia Analytical Services for as-needed sediment testing and laboratory services.  Cost $120,000; term end March 1, 2015.

 

07/31/2012:  Approved entering into a stipulated judgment and settlement agreement in case of Russian River Watershed Protection Committee v. Sonoma County Water Agency.  Sonoma County Superior Court Case No.: SCV-250347 (Govt. Code Section 54956.9 (a)).
