C)                     Authorize the Director of Regional Parks or his designee to approve contract changes up to $50,000, and approve on behalf of the Board any changes to the design made pursuant to such contract changes as may be necessary or appropriate in connection with change orders within the Director’s authority pursuant to Resolution Number 04-0547.

Executive Summary:

The West County Trail Forestville Phase 2 contract award to Murray Building, Inc. will allow for the construction of a trail gap between Highway 116 and Pajaro Lane in Forestville. The trail project includes the construction of an 8 feet wide by 200 feet long wood boardwalk and asphalt pavement that will improve pedestrian and bicycle access into downtown Forestville. Phase 2 construction will be funded by fair share contributions and park mitigation funds. Regional Parks has completed the bid advertisement and the bid selection process. $314,927 is the lowest responsible bid. Regional Parks requests the Board approve the plans and specifications for the proposed West County Trail Forestville Phase 2 project,  authorize the Chair of the Board to execute the Contract with Murray Building, Inc. (Contractor) in the amount of $314,927, and authorize the Director of Regional Parks to approve contract changes up to a maximum of $50,000 and approve on behalf of the Board any changes to the design made pursuant to such contract changes.

 

Discussion:

The West County Regional Trail (“Trail”) is an existing 13.30 mile long Class I bike path/trail that is used daily by local residents and visitors for a variety of activities such as dog walking, jogging, bicycling, and pushing baby strollers. The Trail starts at the Santa Rosa Creek Trail intersection in downtown Santa Rosa and ends at Pajaro Lane in Forestville, it is separated from vehicle traffic, and provides a safe and scenic place to walk and bicycle. The Trail is not limited to recreational use but also provides non-motorized transportation opportunities for pedestrians and bicyclists traveling to or through the following communities: Santa Rosa, Sebastopol, Graton, and Forestville.

 

The Trail is being constructed in phases as funding becomes available. The current construction phase includes the West County Trail Forestville segment which will increase the existing Trail by 0.17 miles. More Trail segments are planned for the future. The construction of the West County Trail Forestville segment was separated into Phases 1 and 2. Phase 1 was completed in August 2019 and included the construction of 700 linear feet of asphalt paved trail. Phase 1 was funded by $200,000 in Transportation Development Act (TDA) Article 3 funds and $18,675 in park mitigation fees. Phase 2 will include the construction of a 200 feet long wood boardwalk and asphalt pavement that will connect the existing paved trail to the south near Pajaro Lane and the paved trail to north, which was completed in Phase 1.

 

By Resolution No. 08-0089, the Board required the applicant of a quarry expansion project to pay a percentage share (Fair Share Contributions) of improvement projects that would mitigate impacts to vehicle, bicycle, and pedestrian circulation in the Forestville area.  On December 11, 2018, by Resolution No. 18-0532, the Board amended Resolution No. 08-0089 to allow certain fair share contributions to be redistributed to bicycle/pedestrian improvements benefiting the downtown Forestville such as the West County Trail.  West County Trail Forestville Phase 2 will be funded by $405,000 dollars of these fair share contributions from the County Road Fund. This amount will cover the costs of the construction contract, construction management, permits and environmental mitigation, and construction change orders that can be executed within the Regional Parks Director delegated authority. The $405,000 will be transferred to the West County Trail Forestville project when the Board approves the first quarter Consolidated Budget Adjustments on November 12, 2019.

 

The West County Trail Forestville Phase 2 construction plans and specifications were available to prospecting bidders beginning September 18, 2019. The project was advertised for bidding on September 27, 2019 in the Press Democrat newspaper and a non-mandatory pre-bid meeting was held at the site on September 30, 2019. Four prospective bidders attended the pre-bid meeting. In response to PG&E’s planned de-energization of its electrical system which would shut off power to portions of the County and County offices beginning on October 9, 2019, the Board proclaimed a local emergency on October 8, 2019 (Resolution 19-0441), one addendum was issued on October 8, 2019 to extend the bidding opening date from October 10 to October 15. On October 15, 2019, bids were opened for the project. Six bids were received. Murray Building, Inc. contractor had the lowest bid of $315,944. A copy of the bid tabulation is attached. Staff evaluated the bids and discovered a multiplication error in Murray’s bid which lowered their bid to $314,927. Murray Building, Inc. acknowledged the error and is willing to accept the contract award in the amount of $314,927. Staff recommends awarding the bid of $314,927 to Murray Building, Inc.

 

Pursuant to Resolution No. 04-0547 the Regional Parks Director maintains authority to approve change orders to construction contracts approved by the Board up to maximum of $50,000 for contracts over $250,000, provided the change order does not affect the material character of the work and the need for the change order result from unforeseen matters which are discovered after the contract was awarded and such modifications are necessary or advisable to complete the project in a timely and efficient manner.  In the unlikely event that significant design related changes are necessary to complete the Project, staff will return to the Board to approve such changes.  However, staff request that the Board authorize the Director or his designee to approve contract changes up to $50,000, and approve on behalf of the Board any changes to the design made pursuant to such contract changes as may be necessary or appropriate in connection with change orders within the Director’s authority pursuant to Resolution No. 04-0547.

 

The construction schedule is 30 days. The tentative construction start date is November 18, 2019.

 

Prior Board Actions:

December 11, 2018, by Resolution No. 18-0532, approved the use of fair share contributions for the West County Trail project.

January 29, 2008, by Resolution No. 08-0089, approved the quarry expansion project with mitigations such as the payment of fair share contributions.

Narrative Explanation of Fiscal Impacts:

 The West County Trail Forestville Phase 2 project will be funded by a transfer of fair share contributions from the County Road Fund in the amount of $405,000.  These funds will cover the cost of construction ($314,927), project management ($25,000), permits and environmental mitigation ($15,073), and contingencies ($50,000).  The $405,000 will be transferred when Board approves the first quarter Consolidated Budget Adjustments on November 12, 2019.
