Authorize the Chair to execute an agreement with EBA Engineering for water quality and landfill gas monitoring services at the closed rural County landfills in Annapolis, Guerneville and Occidental for a period of three years, from September 17, 2019 through September 17, 2022, for an amount not-to-exceed $117,044 annually. Executive Summary:

The Department of Transportation and Public Works (TPW) is recommending the approval of an agreement with EBA Engineering to provide water quality and landfill gas monitoring services at the three former rural landfills commonly known as the Annapolis Landfill, the Guerneville Landfill, and the Occidental Landfill, in an amount not to exceed $117,044 per year, or a total of $351,132 for the three year term. The contract will provide for water monitoring services at the three locations budgeted at a total of $42,044 per year, and miscellaneous costs for items such as retests, annual review, consultations, emergency services, expert testimony, and other additional services for unanticipated gas and water monitoring estimated at $75,000 per year.

 

Discussion:

The County has contracted to perform these services since 1995 as regulatory requirements for monitoring and reporting have significantly increased, and TPW does not have staff with the expertise to meet these requirements. Both federal and state regulations require that owners of closed landfills must monitor water quality and landfill gas and report monitoring results, in order to safeguard the health and welfare of the public and the environment. California Code of Regulations Title 27 (CCR Title 27) and site specific Waste Discharge Requirements (WDRs) issued by the Regional Water Quality Control Board set the regulatory standard for required environmental monitoring and reporting at these sites to ensure facilities are maintained in a manner protective of people and the environment during post closure. The County faces substantial legal penalties for failure to collect and report environmental monitoring data from the County closed landfill sites.

The prior Agreement for these services expired August 2019, for a total of $96,525 per year.

On April 10, 2019, TPW issued a request for proposals for water and landfill gas monitoring services. Proposals from four different suppliers were received, reviewed, and ranked according to qualifications and quality of technical proposals submitted. After proposals were ranked, the top three proposals were then ranked by annual costs of proposals from lowest to highest:

1)                     EBA Engineering …………………………$117,044.

2)                     Montrose Environmental …………$206,760.

3)                     Tetra Tech BAS, Inc. …………………...$262,680.

Upon completion of this review, EBA Engineering was selected based on their technical qualifications and proposed costs. 

EBA Engineering is a local California corporation and a certified small business enterprise, with more than 39 years of experience in the solid waste environmental field and their proposal demonstrated a level of capability and service that will allow them to perform the work in a manner that will meet the County’s regulatory needs. TPW has worked with EBA Engineering for many years on several different environmental projects, including water and gas monitoring at the County’s three closed rural landfills, and is satisfied with the high level of expertise and work performed.

The proposed Agreement will provide for EBA Engineering to perform all work necessary for gas, water and leachate monitoring at the Annapolis, Guerneville, and Occidental closed landfills, for a three-year period. In addition to monitoring services, the Agreement will provide response services for any emergency at the request of TPW.

TPW requests approval and authorization for the Chair to sign an Agreement for Professional Services with EBA Engineering in the amount of $117,044 annually for three (3) years, or a total of $351,132, for water quality and landfill gas monitoring services, and emergency services at the former rural landfills.

Narrative Explanation of Fiscal Impacts:

Total estimated value of work to be completed $117,044 per fiscal year, for a total contract of $351,132. Appropriations for this work were included in the FY 2019-20 Integrated Waste adopted budget.

Funds for maintenance of former rural landfills are generated by the Franchise Agreement between the County of Sonoma and Recology Sonoma-Marin, which became effective in 2009. Franchise fees are collected on a monthly basis. There is no financial impact to the General Fund.
