Authorize the Sheriff to execute a no cost agreement with Los Angeles County for the provision of reciprocal intrastate prisoner transportation services effective July 1, 2019, until terminated by either party. This Agreement benefits the public by implementing cost and operational efficiencies for Intra-state transports.

Executive Summary:
Government Code Section 26775 authorizes counties to enter into reciprocating agreements for service. This agreement, between Los Angeles County and Sonoma County, will allow the Counties to share in their respective responsibilities of transporting arrested persons from the location where they were arrested to the counties where they are charged with a crime. The Agreement requires Board approval because of the mutual indemnification provision in the Agreement.
Discussion:
Persons are frequently arrested in counties throughout the State of California on the authority of warrants issued from other counties. Each investigative agency is responsible for transporting its detainee, from the location where they were arrested to their respective county. The cost of operating these transportation systems is significant for both parties. The Sonoma County Sheriff’s Transportation Unit and Los Angeles County Sheriff’s Department Transportation Bureau have coordinated efforts since 2007 to move detainees from one location to another. Under this Agreement, the parties exchange detainees on a weekly basis at a location near Sacramento, where a wider network of inmate exchanges takes place. This exchange includes detainees from several Southern California counties, as coordination allows. If detainees are not transported through this exchange, Sonoma County Sheriff’s deputies will have to perform the transport. This collaboration creates operational and cost efficiencies by reducing the overall time and resources needed for each individual transport. Los Angeles County is the largest provider of detainee transportation services in the State of California
The Reciprocal Agreement before the Board outlines operational protocols, including how services will be requested, how delivery expectations will be communicated and mutually agreed, and limitations on service provision availability due to space or scheduling issues. The Agreement also contains a provision for mutual indemnification, which is typically standard for these types of agreements. The previous Agreement expired on June 30, 2019. The term of the new Agreement is effective July 1, 2019 and will remain in effect until terminated by either party. There are no costs associated with this Agreement. If the Agreement is not approved, Los Angeles County will not transport detainees to Northern California for Sonoma County. Instead, Sonoma County Sheriff’s deputies will have to travel to Los Angeles County to pick up Sonoma county detainees, resulting in significant increased costs to the County. The Deputy Sheriff’s Association supports contracting out this work.

The Board has approved concurrent Reciprocal Transportation of Prisoners Services Agreements with Los Angeles County since 2007.
