Executive Summary:
US Route 101 south of Petaluma is being improved by the California Department of Transportation (Caltrans) from a highway to a freeway. As a freeway there will no longer be at- grade intersections with local roads; only on-ramps and off-ramps. Caltrans and the County have agreed to close off access to this end of San Antonio Road from the freeway. Caltrans has identified a 2,434 square foot right-of-way area owned by the County that will be needed for the project. This parcel is a portion of San Antonio Road which is beyond where Caltrans is constructing a turn-around at the new proposed dead end of the road. Section 83 permits the State to obtain road right-of-way free of charge from counties when required for State highway. Upon invocation of the State’s power under Section 83, transfer of rights-of-way is compulsory.
The Quitclaim Deed must be notarized at the time of signature.
Discussion:
The requested action is addressing a section of San Antonio Road that lies adjacent to US Highway 101 north of the Marin County/Sonoma County boundary. Caltrans has requested transfer of a portion of San Antonio Road in accordance with Section 83, Streets and Highway Code.
The State has acknowledged that existing public utility facilities may lie within the Section 83 area. These facilities will either be allowed to remain or relocated as part of a separate utility agreement.
Government Code section 25365 allows for conveyances and transfers of real property no longer required to the State of California upon agreed terms, upon a 4/5th vote.

Narrative Explanation of Fiscal Impacts:
Costs associated with the right of way transfer will be minimal and will be primarily made up of employee wages. Funding for this will come from the Highway Users Tax revenue and there are sufficient appropriations in the Roads Budget to cover these costs.
