Executive Summary:

Chapter 7, Section 7-3 of the Sonoma County Code establishes the Board of Building Appeals (BOBA), to hear and rule on matters pertaining to building code interpretation, fire code interpretation and suitability of alternate materials and types of construction. BOBA also hears appeals regarding requirements relating to use, maintenance and change of occupancy of buildings and structures.

 

The Board of Supervisors appoints the seven members of BOBA qualified by experience and training. According to state law, members of the appeals board shall not be employees of the enforcing agency and shall be knowledgeable in the applicable building codes, regulations and ordinances as determined by the Board of Supervisors. According to Section 7-3, the BOBA shall consist of at least one of each of the following:

 

Registered Civil Engineer;

Licensed Architect; and

Contractor with at least a Class B license.

 

BOBA meetings follow Brown Act and generally Robert’s Rules of Order. According to Sonoma County Code, appointed members are paid $125 per half day and $250 for each full day meeting attended. By resolution, the meetings are held at regular times and places. Members serve for four year terms, but may serve until a replacement is appointed following the end of the four year term if needed. BOBA decisions must be made in writing and are final.

 

Discussion:

On June 14, 2019, Paul Schmidt submitted his application to serve as a member of the BOBA. Mr. Schmidt holds a Master of Architecture degree and for over forty years has overseen various construction projects in Sacramento and its surrounding areas. Mr. Schmidt owns a vacation home in Monte Rio, while his permanent residence is in Placer County.

 

Mr. Schmidt meets the Board’s qualifications and his appointment to the Board would ensure that at least one member is a Licensed Architect consistent with the direction of Section 7-3. Accordingly, the Chief Building Official supports this application. Permit Sonoma requests that the Board of Supervisors appoint Mr. Schmidt to the BOBA for a four year term: August 15, 2019 through August 14, 2023.
