Executive Summary:

On July 8, 2019, the Community Advisory Council (CAC) recommended that the Director of Independent Office of Law Enforcement Review and Outreach (IOLERO) make a request to the Board of Supervisors that the Board officially support Assembly Bill 392, The California Act to Save Lives.

 

Discussion:

Assembly Bill 392 (“AB 392”), The California Act to Save Lives, introduced this year by Assembly member Shirley Weber (D-San Diego), will redefine the circumstances under which deadly force can be legally justified when used by a peace officer. In summary, the bill states that police officers may only use deadly force when “necessary” under the “totality of the circumstances” rather than requiring that the officer’s actions be only “reasonable.”

 

AB 392 has garnered a broad range of support in California. On May 29, 2019, AB 392 passed in the Assembly 68 to 0, and on July 8, 2019, the bill passed in the Senate 34 to 3. AB 392 is now awaiting Governor Newsom’s signature.
