A)                     Adopt a Resolution authorizing the Sonoma County Probation Department to enter into an agreement with and to reimburse the California Department of Corrections and Rehabilitation to provide juvenile offender diagnostic treatment services (agreement # C5608234) and juvenile offender temporary detention/emergency housing (agreement # C5608270).

B)                     Authorize the Chief Probation Officer to execute agreements with the California Department of Corrections and Rehabilitation for juvenile offender diagnostic treatment services (# C5608234) and for temporary detention/emergency housing (# C5608270) for a term from July 1, 2019 through June 30, 2021 in an estimated amount of $94,166.40.

Executive Summary:

The recommended action is to authorize the Chief Probation Officer to enter into two agreements with the California Department of Corrections and Rehabilitations (CDCR) to provide diagnostic and treatment services (#C5608234) and to provide temporary detention (#C5608270) of Sonoma County juveniles referred to the CDCR, Division of Juvenile Justice (DJJ), by the Juvenile or Criminal Court.  The two agreements establish the rates, scope, and terms for the County to reimburse CDCR for these services. The total combined agreement costs for the term beginning retroactively from July 1, 2019 through June 30, 2021 is estimated at $94,166.40.  These agreements are required to permit CDCR to accept juveniles who are referred by the Court pursuant to the requirements of the Welfare and Institutions Code Section 1752.1, for diagnostic studies/treatment, and temporary housing.  Under applicable law, the Court may only refer juveniles to the CDCR for such services if they are eligible for commitment to the CDCR and the County lacks the resources or facilities to provide a proper disposition for the juvenile’s case. 

Pursuant to the proposed agreement, the Sonoma County Probation Department will reimburse CDCR (Agreement # C5608234) at a rate of two hundred twenty three dollars ($223.00) dollars per day/per juvenile case for diagnostic studies, treatment services, and case referrals.  The total contract amount is $80,280 for the two-year agreement term.  If the actual costs exceed the contract limit, the County agrees to compensate CDCR at the daily rate of $223.00.  Included in this cost is the provision of routine medical, dental or mental health treatment and routine periodic medical examinations for the referred juveniles. The cost does not include emergency medical or mental health treatment (or related transportation costs), which remain the County’s responsibility to pay.

Pursuant to the proposed agreement, the Sonoma County Probation Department will reimburse CDCR (Agreement # 5608270) at a rate of one hundred fifteen dollars and seventy-two cents ($115.72) per day/per juvenile case for emergency housing.  The total contract amount is $13,886.4 for the two-year agreement term.  If the actual costs exceed the contract limit, the County agrees to compensate CDCR at the daily rate of $115.72.

Discussion:

The cost of institutional housing for juveniles is billed separately to Sonoma County Probation and is not covered in these separate agreements; institutional housing is mandated by W&I Code § 912 at a rate of $65.75 per day.  There are three components for costs incurred to CDCR: 1) institutional housing (DJJ sentenced youth commitments), 2) diagnostics and treatment services, and 3) emergency housing. 

 

In the past, Probation utilized the CDCR diagnostics and treatment services more heavily when Probation lacked local resources or when court ordered. The cost per month for diagnostic and treatment services has been in decline since Probation contracted with the Department of Health Services for dedicated psychologist services in fiscal year 2016-2017.  Currently, Sonoma County Probation uses the Sonoma County Department of Health Services (or their contractor) to provide diagnosis and treatment to DJJ committed youth, at a reduced cost compared to CDCR rates, unless ordered to use CDCR services by the Court.
