Executive Summary:
As a result of the 2019 Winter Storms and Flooding, dangerous conditions had arisen on numerous properties owned or maintained by Sonoma Water that were sudden and unexpected, and posed a clear and imminent danger requiring immediate action to prevent or mitigate the loss or impairment of life, health, property, or essential public services. The Board of Directors for the Sonoma County Water Agency, Russian River County Sanitation District, Occidental County Sanitation District, Sonoma Valley County Sanitation District, and South Park County Sanitation District (collectively “Sonoma Water”) received updates on the work and authorized continued emergency repairs on March 12, March 26, April 9, April 16, April 30, May 14, May 21, June 4, and June 11, 2019. As of July 9, 2019 all emergency repairs have been completed.
Discussion:
On February 26, 2019, the Board of Supervisors for the County of Sonoma declared the existence of a local emergency for the Sonoma County Operational Area due to the 2019 Winter Storms and Flooding that started on February 12, 2019. In response, Sonoma County and Sonoma County Water Agency (Sonoma Water) Emergency Operations Centers (EOCs) were activated on February 26, 2019 to assist with managing the impacts. On February 28, 2019, Governor Newsom issued a proclamation of emergency due to these storms. On March 1, 2019, the General Manager of Sonoma Water determined emergency conditions as a result of the 2019 Winter Storms and Flooding necessitating immediate action pursuant to the authority delegated in Resolutions # 06-0649 and #06-0650.
Due to the February 2019 Winter Storms and Flooding, Sonoma Water, and the Sanitation Districts and Zones owned or operated by Sonoma Water, had suffered damage and emergency conditions existed which necessitated immediate action to protect public health, public safety, essential public services, and property.
Public Contract Code section 22050 authorizes Sonoma Water to enter into contracts for public projects as may be necessary to mitigate emergency conditions without giving notice for bids. Additionally, pursuant to Public Contract Code Section 22035, emergency work may proceed without adopting plans or specifications. Since March 12, 2019, an item has been brought back to the Boards every 14 days to determine [by 4/5 vote] to continue the action without competitive bidding.
Pursuant to the authority vested with the General Manager pursuant to Resolutions 06-0649 and #06-0650, and consistent with Public Contract Code section 22050, The General Manager ordered Sonoma Water staff undertake the following repairs/protective measures:
• Sonoma Valley County Sanitation District manhole bank erosion. Emergency repair/protective measures to protect the manhole and pipe from being damaged in Sonoma Creek;
• Sonoma Water’s Collector 6 has ground/bank erosion exposing underground equipment and lines
• Sonoma Water’s Mirabel and Wohler facilities debris removal and road repairs
• Russian River County Sanitation District Center Lift Station Emergency Generator replacement.
During the course of investigation, staff determined that damage to the Occidental County Sanitation District and the Sonoma Valley County Sanitation District outfall lines were not due to the 2019 Winter Storms and Flooding, but were in fact pre-existing. For this reason, repairs were not made under the emergency declaration.
As of July 9, 2019, 100% of the emergency repairs have been completed. This joint item requests the Boards of Sonoma Water to terminate Emergency Contracting Procedures pursuant to Public Code section 22050.

Narrative Explanation of Fiscal Impacts:
Total emergency costs to date (6/24/2019) are as following:
Sonoma County Water Agency: $239,951
Sonoma Valley County Sanitation District: $154,625
Russian River County Sanitation District: $33,343
Sonoma Water anticipates reimbursements through funds from Federal Emergency Management Agency’s Public Assistance program and the California Governor’s Office of Emergency Services. Sonoma Water is working diligently to adhere to the common funding reimbursement regulations of these programs in order to maximize the probability of successful reimbursement requests.
