B) Direct the Clerk of the Board to publish the Notice of Public Hearing in a newspaper of general circulation at least twice with the first publication at least ten (10) days prior to the date of the hearing and at least five (5) days in between publications, and as may otherwise be required.

Executive Summary:
In order to proceed with undergrounding of existing overhead utilities in the Freestone Underground Utility District No. 1, PG & E has requested the removal of a portion of one parcel from the District and the addition of the remainder of two parcels, in order to conform the district boundaries to the proposed utilities undergrounding design and to otherwise satisfy applicable funding requirements. The requested revisions are identified on the attached “Revised Exhibit B.”
To accomplish the boundary revision, a noticed public hearing is required to be set, at which point your Board would consider the revision and opportunity would be provided for any affected property owner, utility, or member of the public to be heard on the matter.
Discussion:
The procedure of forming an Underground Utility District, consistent with the California Public Utility Commission (CPUC) requirements, is defined in the Sonoma County Code, Chapter 25A Underground Utilities. Underground Utility Districts serve the public necessity, health, safety, and general welfare by requiring removal and underground installation of certain above-ground and overhead poles, wires, and associated structures in designated areas. To form an Underground Utility District, notice and public hearing is provided to owners whose property parcels are in the boundaries of the designated area.
On June 8, 1999, by its Resolution 99-0725, the Board of Supervisors established the Freestone Underground Utility District No. 1 pursuant to Sonoma County Code Chapter 25A. Funding for the majority of the undergrounding and associated work under the District is to be derived from Rule 20A funds (credits) available through Pacific Gas & Electric (PG&E). To satisfy Rule 20A concerns and other requirements, all areas to be undergrounded must be included within District boundaries, and District boundaries must directly coincide with the project boundaries. Based on current design for the contemplated undergrounding project, three parcels need modification to conform District boundaries to project boundaries. Two parcels require additional area; APN 073-080-021 and -071. While the majority of these parcels are already included in the District, the additional portion of each parcel needs to be added. The third parcel area (on APN 073-130-004) is outside of the project design and therefore is to be removed from the District.
PG & E has requested that the above specific revisions be made to the District boundary to conform to the project design. The requested revisions will facilitate the associated Rule 20A funding and enable the long-contemplated undergrounding in the Freestone Underground Utility District area, furthering the public interests served by the District.
Department of Transportation and Public Works staff will send notification of the public hearing to all affected property owners and affected utilities.
