In an ongoing effort to maintain compliance with regulatory permits and to prevent contamination of groundwater:

A)                     Adopt and approve the Project Manual and Drawings entitled Sonoma Valley County Sanitation District Equalization Basins 1, 2, 3, and 4 Geomembrane Relining Project.

B)                     Authorize the General Manager of Sonoma County Water Agency, acting on behalf of the District, to sign Document 00650 (Agreement and Release of Any and All Claims), with County Counsel review, if any unresolved claims are listed by the contractor.

C)                     Award the contract to TerraCon Constructors, Inc., for the amount of $3,198,386, and authorize the Chair of the Board to execute the contract.

D)                     Delegate authority to the General Manager of Sonoma County Water Agency or his designee to approve design changes to the Project as may be necessary or appropriate in connection with change orders within the General Manager’s authority pursuant to Resolution No. 04-0547.

Executive Summary:

This item requests approval of a contract with TerraCon Constructors, Inc. for $3,198,386 for construction of the Sonoma Valley County Sanitation District Equalization Basins 1, 2, 3, and 4 Geomembrane Relining Project (Project).

 

Discussion:

The Sonoma Valley County Sanitation District (District) has four equalization basins at its wastewater treatment plant in need of relining. These basins are critical facilities that are responsible for temporary storage of raw wastewater during times when treatment capacity is limited due to excessive wet weather inflows to the treatment plant. The two smaller equalization basins are concrete basins with a spray applied asphaltic liner, while the two larger equalization basins are earthen basins with a geomembrane liner. All basins were last relined in 1998, and the condition of the liners has deteriorated. Relining of the basins is required to maintain compliance with regulatory permits and to prevent contamination of groundwater.

 

A Notice of Exemption for compliance with the California Environmental Quality Act was filed with the County Clerk on October 24, 2018. The project is exempt based on CEQA Guidelines §15301, Existing Facilities; §15302, Replacement or Reconstruction; and §15304, Minor Alterations to Land.

 

The Project consists of the construction of District’s equalization basins 1, 2, 3 and 4 geomembrane relining located at the District’s wastewater treatment plant at 22675 8th Street East in the unincorporated area of Schellville in Sonoma County, California, outside the city limits of the City of Sonoma. The Project includes, but is not limited to, the relining of each basin with an impermeable layer of geomembrane liner, which anchors in a trench along the top of each basin; the installation of approximately 250 feet of 24-inch diameter pipe between basin 3 and 4; the installation of incidental piping, washdown monitors, and electrical conduit and appurtenances; and construction of a concrete drainage trench in equalization basin 1. The Project shall be completed within 215 Days from the date when Contract Time commences to run. Bidding Documents contain the full description of the work.

Bids for construction of said Project were received on Tuesday, January 29, 2019, as follows:

 

TerraCon Constructors, Inc., Healdsburg, CA:                     $3,198,386

 

The Engineer’s Estimate was $2,488,310.

 

The one and only bid is from TerraCon Constructors, Inc. and is $710,076 above the Engineer’s Estimate.  TerraCon Constructors, Inc. has been found to be responsible, and its bid responsive, additionally TerraCon Constructors, Inc. is experienced in the type of construction and met the experience requirements.  Staff has concluded that this bid outcome, receiving only one bid, is representative of the current bidding environment due to the high amount of post-fire construction activity and is therefore recommending award of the contract.

 

Pursuant to Resolution No. 04-0547, the General Manager maintains authority to approve change orders to construction contracts approved by your Board of up to $50,000 each, provided the change order doesn’t affect the material character of the work and the need for the change order results from unforeseen matters which are discovered after the contract was awarded and such modifications are necessary or advisable to complete the project in a timely and efficient manner. In the unlikely event that significant design-related changes are necessary to complete the Project, staff will return to your Board to approve such changes. However, staff request that your Board authorize the General Manager or his designee to approve design changes as may be necessary or appropriate in connection with change orders within the General Manager’s authority. 

 

A contractor must execute a release of claims (Document 00650) before final payment but may except any unresolved claims from the release. The requested action authorizes the General Manager to approve the release unless the contractor lists unresolved claims. In that case, County Counsel must review Document 00650 prior to the General Manager’s approval.

 

Construction on the Project is scheduled to begin approximately April 15, 2019 with an estimated completion date of November 15, 2019.

 

ALTERNATIVES

There are no viable alternatives to relining the equalization basins. Non approval would compromise the District’s ability to comply with its National Pollution Discharge Elimination System permit and could lead to groundwater contamination from raw sewage.
