Executive Summary:

Welfare and Institutions Code Section 5607 requires that local mental health services are administered by a Local Mental Health Director that is appointed by the governing body. Health and Safety Code Section 11800 requires the Board of Supervisor to appoint an alcohol and drug program administrator. This item requests the appointment of Bill Carter as the Local Mental Health Director and the Alcohol and Drug Program Administrator.

 

Discussion:

Welfare and Institutions Code Section 14712 directs the California Department of Health Care Services to implement and administer Managed Mental Health Care for Medi-Cal eligible residents of California through contracts with mental health plans. The Department of Health Services contracts with the California Department of Health Care Services and operates the Mental Health Plan for Sonoma County.

Welfare and Institutions Code Section 5607 requires that local mental health services are administered by a Local Mental Health Director that is appointed by the governing body. Welfare and Institutions Code Section 5607 also states that directors of local mental health services meet certain standards of training and experience as required by the California Department of Health Care Services. Regulation pertaining to the standards of training and experience for directors of local mental health services is provided in California Code of Regulations, Title 9, Section 620. As a licensed clinical social worker, Bill Carter meets the requirements stated in Section 620(c).

Powers and duties of the Local Mental Health Director are set forth in Welfare and Institutions Code Section 5608 as follows:

a)                     Serve as chief executive officer of the community mental health service responsible to the governing body through administrative channels designated by the governing body.

b)                     Exercise general supervision over mental health services provided under this part.

c)                     Recommend to the governing body, after consultation with the advisory board, the provision of services, establishment of facilities, contracting for services or facilities and other matters necessary or desirable in accomplishing the purposes of this division.

d)                     Submit an annual report to the governing body reporting all activities of the program, including a financial accounting of expenditures and a forecast of anticipated needs for the ensuing year.

e)                     Carry on studies appropriate for the discharge of his or her duties, including the control and prevention of mental disorders.

f)                     Possess authority to enter into negotiations for contracts or agreements for the purpose of providing mental health services in the county.

The Department of Health Services also administers the county alcohol and other drug program. Health and Safety Code Section 11800 requires the Board of Supervisors to appoint an alcohol and drug program administrator to administer, coordinate, and monitor the county alcohol and other drug program.

Responsibilities of the Alcohol and Drug Program Administrator are set forth in Health and Safety Code Section 11801 and include the following:

a)                     Coordinate and be responsible for the preparation of the county contract with the state.

b)                     Ensure compliance with applicable laws relating to discrimination.

c)                     Submit an annual report to the Board of Supervisors reporting all activities of the alcohol and other drug program.

d)                     Be directly responsible for the administration of all alcohol or other drug program funds allocated to the county, administration of county operated programs, and coordination and monitoring of programs that have contracts with the county to provide alcohol and other drug services.

e)                     Ensure the evaluation of alcohol and other drug programs.

f)                     Ensure program quality in compliance with appropriate standards.

g)                     Participate and represent the county in meetings of the County Behavioral Health Directors Association of California for the purposes of representing the counties in their relationship with the state with respect to policies, standards, and administration for alcohol and other drug abuse services.

This item requests the appointment of Bill Carter as the Local Mental Health Director and Alcohol and Drug Program Administrator.

Bill Carter is a state recognized expert in mental health and brings a wealth of experience from Napa County, where he served the past four years as the Mental Health Director of the Napa County Health and Human Services Agency. Bill was the agency’s compliance officer the four years prior. Carter has more than 30 years of experience in mental health and social services programming as a provider and administrator for both private and public sectors. He was an administrator at the California Institute for Mental Health from 1998 to 2010, designing and implementing program improvements and leading efforts to circulate evidence-based practices in the field.
