Executive Summary:
Sonoma County Code requires that the Board of Supervisors issue a roiling permit pursuant to Chapter 23 prior to work or operations in a river, stream, or channel which will decrease the clarity of these waterways. The recommended resolution will issue a roiling permit to Sonoma County Regional Parks under their Water Extraction Facility Replacement Program for work along Calabazas Creek for the period August 21, 2024, through October 15, 2024.
Discussion:
Sonoma County Code Chapter 23 requires that an application for a permit be filed with the Board of Supervisors prior to the performance of certain prescribed work or operations in a river, stream, or channel which will decrease the clarity of these waterways.
The project proposes to temporarily dewater a wet or flowing waterway at two locations (Sites 19 and 29 on Attachment 3-Map) on one Sonoma County parcel as part of the Calabazas Creek Regional Park & Open Space Preserve Sediment Reduction and Road Repair Project.
Staff recommends that the Board issue a roiling permit to Sonoma County Regional Parks. There will be no significant residual impacts affecting water clarity of the rivers or streams of the County. The project will help to prevent erosion and sedimentation into nearby streams along both sides of Calabazas Creek. The work is proposed to commence no earlier than August 21, 2024, and be completed by October 15, 2024.
The Board previously adopted a resolution issuing a roiling permit and necessary permit extensions to Sonoma County Regional Parks for construction work on riparian property along Calabazas Creek (Resolution No. 23-0330). This included adopting the Mitigation Monitoring and Reporting Program and transferring all the applicable mitigation measure compliance obligations from Agricultural Preservation and Open Space District (Ag + Open Space) to Sonoma County Regional Parks, requiring no changes that require environmental review pursuant to California Environmental Quality Act (CEQA) Guidelines section 15162. On October 26, 2023, the Board adopted Ag + Open Space’s Calabazas Creek Open Space Preserve Resource Management Plan, noting that any and all compliance obligations with mitigation measures associated with the plan are the responsibility of Regional Parks. The proposed action finds, pursuant to CEQA Guidelines section 15162(b), that “no further documentation” is. The roiling permit is therefore subject to the mitigation measures adopted with the Management Plan.
The applicant anticipates that one 30-day extension may be required, and staff recommends that the Board pre-approve this extension. The roiling permit and 30-day extension require a 4/5th approval vote by the Board pursuant to the requirements of the 1988 ballot measure that enacted the roiling ordinance (County Code, Chapter 23, Article II).
