A)                     Approve the proposed ground lease agreement with the Bodega Harbour Homeowners Association for the operation and maintenance of the Pinnacle Gulch Trail restroom in Bodega Bay, California; make required findings in support of same pursuant to Government Code section 26227; and authorize the Director of Sonoma County Regional Parks to execute the agreement.

Executive Summary:

Regional Parks proposes the County of Sonoma enter into a Lease Agreement with the Bodega Harbour Homeowners Association for the operation and maintenance of one half of the Pinnacle Gulch Trail golf/public restroom for the period of 25 years from the date of the execution of the agreement.

 

Discussion:

On March 5, 1996, the Board of Supervisors authorized the Bodega Harbour Homeowners Association, a nonprofit entity, to construct a public/golf restroom building as a condition of its use permit for a golf maintenance facility. On August 27, 1996, the Board of Supervisors authorized the Director of Regional Parks to execute a ground lease agreement with the Bodega Harbour Homeowners Association and to grant an easement on County Property at Pinnacle Gulch, Bodega Bay, California.  The Bodega Harbour Homeowners association has built the restroom and operated and maintained one half of the restroom to meet the needs of the public and attendees at the ‘The Links at Bodega Harbour’ golf course. The second half of the restroom is operated by Regional Parks.

 

The County and the Bodega Harbour Homeowners Association wish to enter into a new lease agreement terminating on December 4, 2048, for the operation and maintenance of one half of the Pinnacle Gulch public restroom building and pathway access to the restroom building to meet the needs of the community in the areas of health, public safety, and welfare.  All improvements, repairs and replacements to the restroom building shall be at the Bodega Harbour Homeowners Association’s sole cost and expense upon the County’s prior consent.

Consideration for this agreement comes in an annual rental payment from the Bodega Harbour Homeowner Association in the amount of $100 annually to Regional Parks. 

 

Pursuant to Government Code Section 26227, the Board of Supervisors may fund programs deemed by the Board to be necessary to meet the social needs of the population of the county, including but not limited to, the areas of health, law enforcement, public safety, rehabilitation, welfare, education, and legal services, and the needs of physically, mentally, and financially handicapped persons and aged persons. 

 

Section 26227 also allows the Board of Supervisors to make available to a public agency, nonprofit corporation, or nonprofit association any real property of the county which is not and, during the time of possession, will not be needed for county purposes, to be used to carry out such programs, upon terms and conditions determined by the Board of Supervisors to be in the best interests of the county and the general public.

 

Staff is recommending the Board find that the proposed lease agreement is necessary to meet the social needs of the community in the areas of health and welfare, by allowing proper sanitation and public access to restroom facilities while accessing private and public property nearby, and that the property is not otherwise needed by the County for the term of the agreement. The restroom serves an important public function the continuation of which, absent the license agreement, County may need to use its own resources to continue.
