C) Award the contract to TerraCon Constructors, Inc for the amount of $3,833,721, and authorize the Chair of the Board to execute the contract.
D) Delegate to the General Manager of the Sonoma County Water Agency or his designee the authority to approve design changes to the Project as may be necessary or appropriate in connection with change orders within the General Manager’s authority pursuant to Resolution No. 04-0547.

Executive Summary:
This item requests approval of a contract with Terracon Constructors, In., for $3,833,721 for construction of the Sonoma Booster Station Electrical Upgrade and Pumping Reliability Project (Project). The Project includes an addition to the existing Sonoma Booster Station (SBS) No. 2 building, seismic building upgrades at SBS 1, installation of two new 250 horsepower vertical turbine pumps, modification of the existing switchgear at SBS 2 and replacement of the existing transformer and switchgear at SBS 1; a new 9,000 gallon surge tank, installation of a new 1,270 kilowatt diesel generator, controls, and miscellaneous piping and site work.
Discussion:
The Project is located at the Sonoma County Water Agency’s (Sonoma Water) Sonoma Booster Station Facility at 5204 Montgomery Drive in Santa Rosa, California. The Sonoma Booster Station pumps water from Sonoma Water’s Ralphine tanks at Spring Lake Park to its customers in eastern Santa Rosa, the Valley of the Moon Water District, and City of Sonoma. The booster pump stations are necessary to deliver water to these customers and maintain pressure in the two supply aqueducts.
The Project will improve redundancy and reliability at current water demand levels for the customers it serves in East Santa Rosa and the Sonoma Valley. The new 1,270 kilowatt generator will be capable of running 3 pumps simultaneously during a power outage, a significant improvement over the existing generator, which can operate only one pump. This capability is essential now that power shutdowns during extreme fire weather are expected on a regular basis. The new 9,000 gallon surge tank will protect the piping system from potentially damaging surges in transmission line pressure. The electrical upgrades at both pump station buildings will replace outdated transformers and switchgear.
Sonoma Water has determined that the electrical and seismic upgrades, replacement of the back-up power generator and surge tank, and installation of two booster pumps is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(b)(e), Existing Facilities, and Section 15302(c), Replacement or Reconstruction, because the upgrades and additions of redundant equipment at the Sonoma Booster Pump Station would not involve an expansion of existing operational capacity, additions to existing structures would be less than 50% of the existing floor area, and replacement equipment would have the same purpose and capacity as equipment replaced.
Sonoma Water staff have prepared a Notice of Exemption for the project in accordance with CEQA, the State CEQA Guidelines, and Sonoma Water’s Procedures for the Implementation of CEQA.

The Engineer’s Estimate was $3,895,000.
The lowest responsive and responsible bid is from TerraCon Constructors, Inc and is $61,279 below the Engineer’s Estimate. TerraCon Constructors, Inc is experienced in this type of construction and met the experience requirements.
Pursuant to Resolution No. 04-0547, the General Manager maintains authority to approve change orders to construction contracts approved by the Board of up to $50,000 each, provided the change order doesn’t affect the material character of the work and the need for the change order results from unforeseen matters which are discovered after the contract was awarded and such modifications are necessary or advisable to complete the project in a timely and efficient manner. In the unlikely event that significant design-related changes are necessary to complete the Project, staff will return to the Board to approve such changes. However, staff request that the Board authorize the General Manager or his designee to approve design changes as may be necessary or appropriate in connection with change orders within the General Manager’s authority pursuant to Resolution No. 04-0547.
A contractor must execute a release of claims (Document 00650) before final payment but may except any unresolved claims from the release. The requested action authorizes the General Manager to approve the release unless the contractor lists unresolved claims. In that case, County Counsel must review Document 00650 prior to approval by the General Manager.
Document 00670 (Escrow Bid Documents) of the Project Manual requires that the contractor submit bid preparation documents into an escrow account at a mutually agreeable institution. The documents would be available later for review by Sonoma Water and contractor in case of a dispute.
Construction on the Project is scheduled to begin in mid-October 2019, with an estimated completion date of April 9, 2021.
ALTERNATIVES
Failure to approve will compromise Sonoma Water’s ability to reliably and efficiently operate the portion of Sonoma Water’s aqueduct system that delivers water to Sonoma Valley, particularly during power outages and other emergency operating conditions.
Prior Board Actions:
04/30/2019: Board Action authorizing Sonoma Water to issue up to $14,500,000 of tax-exempt revenue bonds (2019 Revenue Bonds) to finance several facilities and improvements, one which is the Sonoma Booster Station Electrical Upgrade and Pumping Reliability Project.
01/19/2018: Board Action approving the Second Amended Agreement for Engineering and Design Services for Sonoma Booster Station Electrical Upgrade and Pumping Reliability (Project) with HDR Engineering, Inc., to provide engineering design services for the Project, increasing the amount by $400,000 with a new not-to-exceed total of $550,000, expanding the scope of work to include design of the entire Project, and extending the agreement term by three years to an end date of June 30, 2021.
12/15/2015: Board Action approving an agreement with Infra Terra, Inc. to conduct a fault evaluation study and related services at the Sonoma Booster Pump Station for the amount of $107,687.

Narrative Explanation of Fiscal Impacts:
Budgeted amount of $3,833,721 is available from FY 2019/2020 appropriations for the Water Transmission System Sonoma Aqueduct Capital Fund. No additional appropriation is required. Costs for the project will be supported by water rates from the Valley of the Moon Water District and City of Sonoma.
