B) Authorize the Director of Health Services, or designee, to execute the first amendment to the agreement with Catherine Marie McKenzie, DVM, subject to review and approval as to form by County Counsel, to provide veterinary services in the County’s animal shelter through June 30, 2026, in an amount not-to-exceed $554,435. Amendment increases the contract maximum contract amount by $15,000.
C) Authorize the Director of the Department of Health Services, or designee, to execute a memorandum of understanding with the City of Petaluma, subject to review and approval as to form by County Counsel, for the County of Sonoma to provide Tobacco Retailer Licensing Program administration and compliance services for City of Petaluma for the term of July 1, 2024 through June 30, 2025, resulting in revenue to the Department of Health Services in the amount of $20,475.
D) Adopt a Resolution authorizing budgetary adjustments in the amount of $35,500 to the fiscal year 2024-2025 adopted budget to reflect revenues and expenditures associated with Public Health agreements.

Executive Summary:
The Department of Health Services (hereinafter, “DHS” or “the Department”) contracts with a broad range of providers of public health services. In order to deliver timely access to high-quality services, Department staff requests authority to execute agreements for public health services, as well as related support services provided by partner agencies.
This item requests the Board of Supervisors authorize the Director of Health Services, or designee, to execute the following contract actions and adopt a budget resolution:
• Execute a data sharing agreement with SacValley MedShare for secure electronic health information exchange services for the period of January 1, 2024 through December 31, 2026 for a not to exceed amount of $62,000. In addition, SacValley MedShare is seeking indemnification from the County, which requires approval from the Board.
• Execute the first amendment to the agreement with Catherine Marie McKenzie, DVM, to provide veterinary services in the County’s animal shelter through June 30, 2026, increasing the contract by $15,000, for a not to exceed amount of $554,435.
• Execute a memorandum of understanding with the City of Petaluma for the County of Sonoma to provide Tobacco Retailer Licensing (TRL) administration and compliance of the Tobacco Retailer License program for City of Petaluma and to accept fee revenue in the amount of $20,475 for the period July 1, 2024, through June 30, 2025.
Discussion:
Public Health Laboratory - Data Sharing Agreement
SacValley MedShare offers secure electronic health information exchange services, enabling seamless sharing of critical health data among healthcare providers. This data sharing agreement aims to enhance collaboration and improve patient care outcomes within our healthcare network. The proposed agreement term is from January 1, 2024, through December 31, 2026, with a not-to-exceed amount of $62,000 to cover the associated costs.
The Department requests the Board of Supervisors authorize the Director of Health Services, or designee, to execute the proposed amendment to the agreement with SacValley MedShare.
This item also requests approval from the Board of Supervisors to enter into the agreement with SacValley MedShare because the SacValley MedShare is seeking indemnification from the County, which requires approval from the Board. The County would indemnify SacValley MedShare for any claims arising from the County’s acts or omissions relating to data breaches or unauthorized access to electronic Protected Health Information. The agreement has been reviewed by Counsel who concurs with recommending the Board approve authorizing the DHS Director to enter into and execute the agreement.
Sonoma County Animal Services - Veterinarian Services
Sonoma County Animal Services contract with Dr. McKenzie for Veterinary services to provide the appropriate and high-level veterinary care for every animal taken in at the shelter. Dr. McKenzie performs the spay or neuter surgery for every dog and cat. Dr. McKenzie performs all necessary surgeries for shelter animals, such as amputations, eye removals, and dental care including tooth removals. The population housed at Sonoma County’s animal shelter has increased over the last year. With the shelter population being at full capacity, there are more animals needing veterinary care. Ensuring that all animals receive the appropriate and best level care has resulted in more hours worked by Dr. McKenzie.
The current contract amount is $539,435 which includes $87,815 in FY 2022-2023; $150,540 in FY 2023-2024; $150,540 in FY 2024-2025, and $150,540 in FY 2025-2026. The proposed amendment will increase the contract maximum amount by $15,000 to account for increased costs in FY2024-2025.
Tobacco Prevention Program - Tobacco Retailer Licensing Administration - City of Petaluma
The Department is requesting approval to enter into a memorandum of understanding (MOU) with the City of Petaluma under which the Department will provide administration and compliance services related to the City of Petaluma’s Tobacco Retailer Licensing (TRL) program. DHS staff currently administer the City of Petaluma’s TRL program, as well as the County’s and the Town of Windsor’s TRL programs and have the systems and procedures in place to efficiently provide TRL program administration and compliance activities to the City of Petaluma. Under the MOU, the Department will have authority to conduct education and one compliance visit in a 12-month period to each tobacco retailer, with the City of Petaluma providing final decision on any potential suspension or revocation of license while issuing associated citations and administrative hearing processes.
The memorandum of understanding details the roles and responsibilities of the County and the City of Petaluma and will be substantially similar to the form attached as Attachment 1. Under the terms of the MOU, the County will collect and retain the license fees from an estimated 40 tobacco retailers doing business in the City of Petaluma. The projected fee revenue of $20,475 per fiscal year will cover the cost of providing the administration and compliance services including one annual retailer site visit.

On December 13, 2022, the Board of Supervisors authorized the Director of Health Services, or designee, to execute an agreement with Catherine Marie McKenzie, DVM, to provide veterinary services in the County's animal shelter through June 30, 2026, in an amount not to exceed $539,435, including $87,815 in fiscal year 2022-2023.
On July 18, 2023, the Board of Supervisors authorized the Director of Health Services, or designee, to execute a memorandum of understanding with the City of Petaluma for the County to receive revenue for providing administration and compliance of the Tobacco Retailer License program for the City of Petaluma for the period of July 1, 2023, through June 30, 2024.

Narrative Explanation of Fiscal Impacts:
The requested appropriations of $35,500 in FY 24-25 is comprised of the following:
• The SacValley MedShare agreement is a multi-year contract (from 01/01/2024 through 12/31/2026) with the recommended action to increase appropriations by $20,500 in the FY 24-25 budget to a new contract max of $62,000. The Department of Health Care Services (DHCS) is covering the $20,500 augmentation for this program.
• DHS is proposing to increase the contract with Dr. Catherine Marie McKenzie, DVM, $15,000 in FY 24-25. Fees from the additional animal procedures performed will cover the additional $15,000. General Fund was already budgeted to cover 90% of the original contract, with fees covering the remaining 10%.
• The revenue agreement with the City of Petaluma for $20,475 is included already in the FY 24-25 adopted budget, and DHS is requesting delegated authority to execute the agreement.
