Authorize the Chair of the Board to execute the third amendment to the Personal Services Agreement with Bert Whitaker, Director of Regional Parks, extending the term for three years from October 3, 2023, through October 3, 2026, continuing at the “I” step in the position’s salary range, and maintaining eligibility for other County benefits in accordance with Salary Resolution 95-0926.

Executive Summary:

Salary and benefits provided to County department and agency heads must be considered by the Board of Supervisors at a regularly scheduled Board meeting. Further, an oral summary of the salary and benefits recommended action must be presented at the meeting where the final Board action is taken. (California Government code §54953, 54956)

 

Bert Whitaker was initially appointed as the Director of Regional Parks on May 23, 2017, for a three-year term, from May 26, 2017, through May 26, 2020. The First Amendment to the Agreement was executed for an additional three-year term from June 2, 2020, through May 26, 2023. The Second Amendment to the Agreement was executed for an additional six months from May 23, 2023, through November 26, 2023. The recommended action extends the term of the current agreement for an additional three years, from October 3, 2023, through October 3, 2026.

 

Discussion:

The Director of Regional Parks reports to the Board of Supervisors and is responsible for park operations and maintenance, natural resource management, planning and acquisition, community engagement, administration, and marketing, and the oversight of three marinas. The Regional Parks Department has approximately 139 full time employees and an operating budget of $54.4 million. Regional Parks is responsible for maintaining 58 facilities including parks, beaches, marinas and trails encompassing approximately 16,237 acres. Regional Parks preserves natural and cultural resources and offers opportunities for education to enhance the visitor experience.

 

Following a nationwide recruitment, Mr. Whitaker was initially appointed to the position for a three-year term, from May 26, 2017, through May 26, 2020, followed by a three-year extension by way of an amendment to the Personal Services Agreement, through May 26, 2023. The second amendment was executed to extend for an additional six months from May 23, 2023 through November 26, 2023, in order to allow sufficient time to complete a performance review and return to the Board for additional action. Today’s recommended action extends the term of Mr. Whittaker’s current agreement for an additional three years from October 3, 2023, through October 3, 2026. Mr. Whitaker’s rate of pay is the “I” step of the salary range, which is $224,908 annually. He will continue to receive all other benefits and compensation as prescribed in the County’s Salary Resolution 95-0926.
