Executive Summary:
The Board of Supervisors is responsible for appointments to over 75 Boards, Commissions, Committees, and Task Forces. Vacancies and upcoming expiring appointments are posted on the County’s list of Boards, Commissions, Committees, and Task Forces website: <https://sonoma-county.granicus.com/boards/w/808bd6e42edf8e0f>. Rule 50 of the Board Rules of Procedures states that the Clerk of the Board shall convene staff to review prospective countywide appointments and make appointment recommendations to the Board.
The City of Santa Rosa adopted a Resolution that established the Santa Rosa Enhanced Infrastructure Financing District - Public Financing Authority (SR-EIFD-PFA) as the legislative body of the Santa Rosa Enhanced Infrastructure Financing District. The SR-EIFD-PFA is made up of seven members: two members from the Santa Rosa City Council (City), two members from the County Board of Supervisors (County) and three public members. Of the three public members, one is appointed by the City, one is appointed by the County and one is a joint appointment by both the City and the County.
This item recommends a rank order preference of the County applicants for the joint County/City Public Member position on the SR-EIFD-PFA. The item also requests delegated authority for Chair Coursey and Vice-Chair Rabbitt to work with the City of Santa Rosa SR-EIFD-PFA appointees to finalize the selection of the joint Public Member appointee from the three County applicants.
Discussion:
An Enhanced Infrastructure Financing District, or EIFD, is a type of special financing district that uses a portion of property tax increment revenues generated by community growth from a specifically defined area to finance public infrastructure and economic development projects of community-wide significance. EIFD law requires the establishment of a Public Financing Authority (PFA) to serve as the governing body of the EIFD. The PFA develops, authorizes, and implements an Infrastructure Finance Plan that guides the EIFD. It oversees EIFD finances and activities in accordance with California Government Code Section 53398.50 et seq.
The role of the Public Financing Authority is to authorize, develop, and eventually implement the Infrastructure Finance Plan (IFP), the EIFD’s investment program. The IFP describes the allocation by taxing jurisdictions to the EIFD of certain incremental property tax revenue for the purpose of funding infrastructure projects and the fiscal impacts analysis. The IFP also includes a general description of projects and will be subject to the review and approval by resolution of the City Council following a public hearing; review and approval by resolution of the Board of Supervisors; and adoption and implementation by the PFA following three public hearings. If the IFP Plan is approved, the PFA would oversee EIFD finances and activities.
The membership of the PFA will consist of seven members: two members of the Santa Rosa City Council, two members of the Board of Supervisors of the County of Sonoma, and three members of the public (Public Member). The City of Santa Rosa approved a resolution establishing the PFA on April 25, 2023. The Santa Rosa City Council approved Councilmembers Victoria Fleming and Chris Rogers as its appointments to the PFA on May 23, 2023. On July 18, 2023, the Board of Supervisors appointed Supervisors Chris Coursey and David Rabbitt as the two members from the Board of Supervisors. Each of the City Council and the Board of Supervisors may also appoint one of its members to be an alternate member who may serve and vote in place of a member who is absent or disqualifies themselves from participating in a meeting of the PFA.
One public member is appointed by the City Council, one public member is appointed by the Board of Supervisors, and one public member is appointed by both the City Council and the Board of Supervisors, each in accordance with California Government Code Sections 54970 and 54972. On August 22, 2023, the Board appointed Caroline Judy as the County EIFD-PFA Public Member.
For the joint County/City Public Member to be appointed by both the City Council and the Board of Supervisors, staff recommends the Board approve first, second, and third recommendations for appointment from the remaining County SR-EIFD-PFA applicants. These applicants were interviewed by Chair Coursey and Vice-Chair Rabbitt on September 25, 2023. In order of preference, the recommendation is as follows: 1) Carmen Gonzalez, 2) Michael Hogan, and 3) Arthur Deicke. Staff seeks delegated authority for the Supervisors appointed to the SR-EIFD-PFA to discuss and come to agreement with the City SR-EIFD-PFA members to select the joint and final public member appointee from these three applicants.
