A) Pursuant to Government Code §7522.56 approve the appointment of John Monaghan as a Water Agency Land Surveyor Extra-Help, in order to fill a critically needed position within 180 days of his retirement, with an appointment date as early as October 18, 2022.
B) Adopt a Resolution Authorizing Adjustment to the Board Adopted Budget for Fiscal Year 2022/2023 for the Sonoma Water General Fund in the amount of $79,392 for the Sonoma County Water Agency (Sonoma Water) Appointment of Retiree Extra-Help.

Executive Summary:
Pursuant to the California Public Employees’ Pension Reform Act (PEPRA), Government Code §7522.56, an exception can be made to reappoint a retiree as extra-help provided the governing body certifies that the appointment is necessary to fill a critically needed position, in those circumstances where 180 days from the date of retirement has not yet passed. This approval must be in a noticed public meeting and not on a consent calendar. PEPRA includes other requirements in order for a retiree to be eligible for an Extra-Help appointment, such as not having accepted a retirement incentive and not having accepted unemployment arising out of prior public appointment. The individual and delegated agency staff have completed the Retiree Extra-Help Compliance Form certifying the appropriateness of the appointment.
Discussion:
John Monaghan, Water Agency Land Surveyor, retired on August 23, 2022. He was hired as a Licensed Land Surveyor in permanent position in the Engineering Division on April 5, 2006, and was promoted to Water Agency Land Surveyor on December 14, 2010. He has served in this capacity in increasing responsibility and has participated in many critical Sonoma Water projects and initiatives including those pertaining to flood, wildfire and climate resiliency.
As manager of the Survey and Right of Way teams, Mr. Monaghan was responsible for many critical Sonoma Water projects and programs including the following:
• Dry Creek Habitat Enhancement Projects, which address fish habitat issues, associated with high flows in Dry Creek by constructing fish habitat features in Dry Creek while accommodating stream flows necessary to support water supply.
• Santa Rosa Plain Wells Drought Resiliency Project, which expands and improves the resiliency of the drinking water supply for over 600,000 people in Sonoma and Marin counties, while also supporting sustainable groundwater management by enabling aquifer storage and recovery, which is funded by a CA Department of Water Resources grant.
• Seismic Hazard Mitigation at the Russian River Crossing, which will minimize the risk of pipe failure and maintain safe and reliable water service during a seismic event that could result in permanent ground deformation along the Rodger's Creek/Hayward Fault. The project involves modifying and replacing portions of the existing crossing, including approximately 1400 feet of concrete cylinder pipe ranging in size between 36 and 48-inch diameter. The project also includes trenching within the riverbanks to replace portions of the pipeline at risk. The project is partially funded with FEMA hazard mitigation funding.
• Laguna-Mark West Watershed Restoration, which will restore wetland and riparian habitat by restoring the alignment of a section of the Laguna de Santa Rosa to its historical path. The project will reconstruct the historical channel and reconnect two seasonal tributary channels from the east, construct an ecological maintenance access path, and revegetate the site with native wetland and riparian plants.
• Occidental to Graton Pipeline project, which proposes to construct a pipe to transport untreated wastewater from Occidental County Sanitation District to Graton Community Services District for treatment and disposal. The proposed pipeline will be located in a mixture of public streets and within easements through private properties. The project will install approximately 30,000 feet of new pipeline requiring extensive right of way acquisitions and mapping surveys. Implementation is dependent on future grant funding and CEQA approval.
Due to the urgency of these efforts related to Sonoma Water’s water supply, flood control, and wastewater systems, it is paramount that Mr. Monaghan continue to provide such support as may be required for the success of those efforts.
Mr. Monaghan possesses considerable expertise in the management of the survey and right of way aspects of all Sonoma Water’s capital projects and regular operations and maintenance activities. This requires extensive experience and strong, collaborative work ethic. Sonoma Water continues to rely on the relationships built by Mr. Monaghan, as well as his unique set of capabilities and strengths. Given the many current needs in the realm of survey and right of way, his continued involvement is critical for successful outcomes. At a minimum, Sonoma Water will benefit from Mr. Monaghan’s relationships and skill sets through fiscal years 22/23, 23/24, and 24/25. Staff respectfully request consideration be given to appointment of John Monaghan as Retiree Extra-Help to continue this critical work to keep these important projects on track.
Sonoma Water staff has consulted with the Human Resources Department, which is supportive of the recommended action.
In accordance with Government Code section 7522.56, Sonoma Water staff is asking the Board certify as follows:
• John Monaghan’s appointment to Water Agency Land Surveyor, Retiree Extra-Help is necessary to fill a critically needed position within 180 days of his retirement date;
• John Monaghan did not accept retirement incentives upon his retirement; and
• John Monaghan’s appointment shall not exceed 960 hours per year.
• Per Internal Revenue Code section 401(a)(36), John Monaghan meets the requirement of being of normal retirement age.
If the Board of Directors makes the foregoing certifications, John Monaghan will be hired as of October 18, 2022 as Water Agency Land Surveyor, Retiree Extra-Help.

Narrative Explanation of Fiscal Impacts:
The cost of the extra help retiree position is approximately $79,392 assuming usage of 960 extra help hours at $82.70/hour. It is projected that 960 hours will be expended in all three fiscal years. FY 2022/2023 additional appropriations in the amount of $79,392 from the Sonoma Water’s General Fund are required. A budgetary resolution has been submitted with this item. Expenses for FY 2023/2024 and FY 2024/2025 will be budgeted in those fiscal years.
Salary and benefits are budgeted in the General Fund which is funded through property tax revenue and grants. The General Fund is reimbursed by our enterprise funds through project costing. Sonoma Water’s cost accounting system allocates labor costs to Sonoma Water projects specific to its enterprise funds.
