Executive Summary:

The City of Santa Rosa (City) is currently implementing two water system improvement projects within the South Park County Sanitation District (District) service area that will include replacement of District sewer assets. Additional coordinated projects are likely in the coming years. Funding agreements will be required between the City and District to provide reimbursement for administrative, design, and construction costs associated with the replacement of District assets for projects executed by the City, or for replacement of City assets by a project executed by District. District is requesting delegated authority for the General Manager of the Sonoma County Water Agency to execute specified funding agreements with the City.

 

Discussion:

In June of 2012, the District and the City entered into an Amended and Restated Agreement Regarding South Park County Sanitation District Operations and Transfer to the City of Santa Rosa (Agreement). The Agreement defines the roles and responsibilities of the City and the District pertaining to maintenance and ownership, respectively, of District sewer assets until the criteria for dissolution of the District have been met.

 

The City is currently planning two water system improvement projects within the District boundary that will include the replacement of District sewer assets. Additional coordinated projects are likely in the coming years. Funding agreements will be required between the City and District to provide reimbursement for administrative, design, and construction costs for replacing District assets by projects executed by the City, or for replacing City assets by projects executed by the District. Where District and City capital improvement projects overlap, there is a significant opportunity to collaborate on projects that will reduce redundant surface improvements, construction contract procurement costs, and administrative costs. Taking advantage of these efficiencies requires proactive planning by City and District staff and timely development of funding agreements.

 

Currently, negotiating a funding agreement for a capital project with the City of Santa Rosa can take between eight to twelve weeks. Another six to eight weeks is required for preparation, scheduling, and processing of an agenda item authorizing the General Manager to execute the funding agreement on behalf of the Board. To promote efficient and effective use of District staff, Board of Directors staff, and promote efficient delivery of capital projects, District is requesting delegated authority for the General Manager of the Sonoma County Water Agency to execute specified funding agreements, in a form approved by County Counsel, without separate Board Action, provided that the aggregate amounts are within the Board approved District annual budget and the project is subject to future California Environmental Quality Act (CEQA) review.

 

California Environmental Quality Act

The requested delegated authority is for a fiscal arrangement and is not a project subject to CEQA as defined in State CEQA Guidelines section 15378(b)(4). The delegated authority does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. Future projects identified to be potentially reimbursed under reimbursement agreements will be subject to future environmental review pursuant to CEQA as described in the agreement conditions.

South Park County Sanitation District sewer upgrades are critical to providing continued customer service, protecting water quality and the environment, and furthering progress toward transfer of the District to the City of Santa Rosa.
