Executive Summary:
Sonoma County Water Agency (Sonoma Water) is required to meet hazardous waste and environmental regulatory requirements pertaining to potable water, hazardous materials management, and air quality. To meet these requirements, Sonoma Water needs support services including assistance with permitting and compliance documentation.
Discussion:
HISTORY OF ITEM/BACKGROUND
Title 40 of the Code of Federal Regulations, Part 112 requires facilities with an aggregate aboveground oil storage capacity greater than 1,320 gallons or a completely buried storage capacity greater than 42,000 gallons to have a Spill Prevention, Control, and Countermeasure (SPCC) Plan. SPCC Plan requirements include routinely inspecting oil storage areas, training, and updating plans every five years.
The California Health and Safety Code section 25501(m) requires applicable facilities to complete and submit a Hazardous Materials Business Plan (HMBP). Sonoma Water is subject to HMBP requirements at thirteen water transmission facilities.
In addition, both the SPCC and HMBP programs require annual training for Sonoma Water staff.
Sonoma Water is also subject to air quality permitting within the Bay Area Air Quality Management District and the North Sonoma County Air Pollution Control District.
To comply with these environmental regulatory requirements, Sonoma Water needs support services including assistance with the SPCCP, the HMBP, and air quality permitting.
SELECTION PROCESS
Stone Creek Environmental Consulting, LLC (Consultant) was selected from a list of qualified consultants developed from a competitive selection process. Attached is a memo that explains the competitive selection process.
Consultant was selected for the subject work because of its extensive knowledge of hazardous waste regulations and environmental regulatory requirements in California.
Sonoma Water may seek to amend or enter into subsequent agreement(s) with Board approval if required, relying upon this competitive selection process, after the preliminary or initial work is completed.
SERVICES TO BE PERFORMED
Under the agreement, Consultant will provide hazardous waste regulatory support services for Sonoma Water’s water transmission system facilities, including assisting Sonoma Water with implementing air quality permits, updating SPCC Plans and HMBPs for Sonoma Water’s transmission facilities, and providing the required annual SPCC and HMBP training to Sonoma Water staff.
The cost of services will not exceed $250,000; the term end date is January 27, 2030.
Under the agreement, the General Manager shall have the ability to extend the term of the agreement for up to two additional years by providing written notice to the other party thirty days in advance of the expiration date. The extension shall be formalized in an amended agreement or amendment signed by the parties.

The services performed under the agreement help Sonoma Water comply with environmental regulatory requirements pertaining to water quality for its water transmission infrastructure. This ensures that Sonoma Water will continue to provide safe water supply to its customers and effectively manage the water resources in its care.

Narrative Explanation of Fiscal Impacts:
Budgeted amount of $50,000 is available from FY 2024/2025 appropriations for the Water Transmission Operations & Maintenance Fund. FY 2025/2026, 2026/2027, 2027/2028, and 2028/2029 appropriations will be budgeted in those fiscal years.
