Executive Summary:

This request authorizes the Sheriff to sign an Agreement with Lind Marine, LLC to provide marine vessel salvage and disposal services through September 30, 2025, for a total amount not-to exceed $155,000. If approved, this Agreement allows the Sheriff’s Office to utilize funds awarded by the Surrendered and Abandoned Vessel Exchange (SAVE) grant program to mitigate the impacts of abandoned recreational vessels on waterways in Sonoma County.

 

Discussion:

The Sonoma County Sheriff’s Office Marine Unit maintains primary law enforcement jurisdiction over Sonoma County’s waterways: Bodega Bay, coastal Pacific Ocean, Lake Sonoma, Russian River, Petaluma River/San Pablo Bay, and the Gualala River.

 

The Surrendered and Abandoned Vessel Exchange (SAVE) grant from the California Department of Parks and Recreation, Division of Boating and Waterways (DBW) is available statewide to qualified local public agencies with jurisdiction over navigable waterways. The grant promotes navigational and environmental safety on Sonoma County waterways by removing, reducing, and preventing abandoned recreational vessels and marine debris.

 

Under Harbors and Navigation Code, Section 526.1, a "surrendered vessel" is a recreational vessel that the verified titleholder has willingly surrendered to an accepting public agency under both of the following conditions:

​(a) the public agency has determined that the vessel is in danger of being abandoned, and therefore has a likelihood of causing environmental degradation or becoming a hazard to navigation.

​(b) the decision to accept a vessel is based solely on the potential of the vessel to likely be abandoned and cause environmental degradation or become a hazard to navigation.

 

​Vessels that are on the water, partially submerged, or sunken can require services beyond the capabilities of the Sheriff’s Office. This Agreement will allow the Sheriff’s Office to contract with Lind Marine, LLC for the required expertise, staff, and equipment to effectively salvage and dispose of these vessels. County Purchasing has approved a single source waiver recognizing Lind Marine, LLC as the only local provider of marine salvage and disposal services.

 

The amount of the Agreement, not-to-exceed $155,000, provides for the Sheriff-Coroner to evaluate and approve proposals submitted by Lind Marine, LLC for any identified abandoned vessels that qualify for SAVE grant fund reimbursement during the remainder of the current SAVE-24 grant performance period, up to the grant award amount.

Narrative Explanation of Fiscal Impacts:

The Sheriff’s Office FY 25-26 Adopted Budget includes appropriations for estimated contract expenditures and offsetting grant revenue. If appropriations are needed above what was included in the FY 25-26 Adopted Budget, the Sheriff’s Office will work with the County Administrator’s Office to appropriate remaining grant funds as part of a Consolidated Budget Adjustment.
