Executive Summary:
The recommended resolution will authorize the chair to Annex APN’s 128-161-013, 128-162-002, 128-162-022, 128-162-023, the area of current 128-161-002, and the area of current 128-161-003 requesting Annexation, and APN’s 128-162-028 and 128-161-039 to be annexed under existing Outside Service Area Agreements (OSAA) into Sonoma Valley County Sanitation District.
Discussion:
The Sonoma County Permit and Resource Management Department (Permit Sonoma) has received a request from Graham Crawford, owner of 20460 Harrington Drive, for annexation to the Sonoma Valley County Sanitation District (District) on behalf of six property owners. The parcels, addresses and respective owners are as follows:
128-162-002 20460 Harrington Drive - Graham Coman Crawford and Susan E. Ostapak, husband and wife as, community property with right of survivorship
128-162-022 20396 Harrington Drive - Kenneth J. Philpot and Angela M. Steel, husband and wife as community property with right of survivorship
Parcel resultant from a lot line adjustment of 128-161-002, plus a portion of 128-161-003 as described under Exhibit A, in Record Document Number2019055752, with both parcels outside of the District. 20400 5th Street West - Gavin Pierce and Connie Pierce, husband and wife as joint tenants

Permit Sonoma also received a request from the Local Agency Formation Commission (LAFCO) for annexation to the District of two additional residential parcels that each currently have sewer service under Outside Service Area Agreements (OSAA), respectively. The OSAA’s require that the “OWNER agrees to annex or support proceedings to annex or proceedings that would lead to the annexation of PARCEL to DISTRICT or CITY and to waive all rights to protest such annexation proceedings for PARCEL to DISTRICT or CITY whenever such annexation proceedings are commenced.” The following additional parcels are part of this resolution for annexation to the District:
128-162-028 20368 Harrington Drive and 128-161-039 20363 Harrington Drive.
The six parcels whose owners are requesting annexation are developed residential parcels on old septic systems that do not meet current septic system standards. The parcels are between 0.36 and 2.80 acres in size, with single-family residences, ADU’s, axillary buildings, trees, shrubs, and grasses.
Annexation of the eight subject parcels to the District will help diminish the size of the non-sanitation district “island” from the County’s General Plan. All eight parcels are within the District’s Urban Services Area boundary, and Sphere of Influence.
Following approval of the annexation by the District Board of Directors, the representative for the six parcels shall submit an application to LAFCO for review and approval of the annexation. Annexation of all eight parcels shall not be effective until the annexation has been approved by LAFCO, and a LAFCO Certificate of Completion has been recorded with the Sonoma County Recorder’s Office.
All six parcels included in the annexation request front existing sewer mains in the street. Each parcel will connect, with permits, to the fronting sewer main, provided annexation is approved. The two parcels with existing OSAA will maintain their existing connections.
Provided annexation is granted, all existing septic tanks shall be decommissioned in accordance with Permit Sonoma Well and Septic Division’s Septic Tank Destruction Permits, and Septic Tank Destruction Requirements, therein. Tank destruct permits shall be issued by Permit Sonoma for abandonment of the existing septic systems. Abandonment of each septic system shall occur at the time of connection to the sewer system, and shall be observed and approved by an Inspector from the Permit Sonoma Engineering Division.
Permit Sonoma Comprehensive Planning staff has determined that these Parcels are located outside of, but adjacent to, the District boundary and are not entitled to connect to or use District facilities until the Parcels have been annexed to the District. Further, the Parcels are located inside the District’s Urban Service Area boundary, as shown on the Sonoma County General Plan 2020 Land Use Element map. Thus, annexation is consistent with the General Plan because it does not require the extension of public sewer outside of the District’s Urban Service Area. The Parcels are also not located in the service area of any other jurisdiction having the ability to provide public sewer service. Staff further determined that annexation of the parcels into the District is desired in order to provide sewer service to the existing, developed single-family parcels and that the District has sufficient sewer capacity.Following resolution of support for the annexation by the Board of Directors, the Owners are required to submit an application to LAFCO for evaluation and approval of the annexation. In accordance with District’s ordinances, and prior to connection to the public sanitary sewer collection system, the Owners must pay sewer Connection and Annual Service fees based on the District’s most current fee schedule.
The District’s General Manager has determined that support of the approval of the annexation is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15016(b)(3) Review for Exemption, as supporting the proposed annexation which Permit Sonoma staff has determined is not contrary to the policies of the Public Facilities and Services Element of the Sonoma County General Plan, would not have a significant effect on the environment, and where upon LAFCO’s approval of the annexation of the Parcels, is exempt pursuant to Section 15301(b), Existing Facilities, as it represents additional connections to an existing public facility that involves negligible or no expansion of an existing or former use. District staff has prepared a Notice of Exemption in accordance with the CEQA, the State CEQA Guidelines and the District’s Procedures for the Implementation of CEQA.
Permit Sonoma staff and Water Agency staff, on behalf of the Sonoma Valley County Sanitation District, support approval of this annexation to the District.
