Executive Summary:
The recommended resolution authorizes the Chair to execute an Outside Service Area Agreement between the Sonoma Valley County Sanitation District and the property owners for public sewer service to property located at Assessor Parcel Number 052-452-005 on Linden Street, Sonoma.
Discussion:
The Sonoma County Permit and Resource Management Department (Permit Sonoma) has received application for an Outside Service Area Agreement (OSAA) to provide public sewer service to the property located at 19347 Linden Street in Sonoma. BC Engineering Group submitted the application on behalf of the property owners, Gene and Lydia Barrot, Trustees of the Gene L. Barrot and Lydia Gail Barrot Trust.
The applicant intends to connect one existing single-family dwelling (SFD) and a duplex on approximately 0.77 acres, zoned Low Density Residential District, 2 Dwelling Units/Acre, Valley Oak Habitat and Vacation Rental Exclusion (R1 B6 2 DU, VOH X). Permit Sonoma Planning staff has determined that the existing SFD and duplex are legally non-conforming.
Currently, the SFD and duplex are connected to separate on-site septic systems. The septic systems are many decades old. Tom Billeter, P.E., BC Engineering’s septic consultant reviewed both septic systems and found each to be failing. In addition, it was determined that the restrictive site conditions prevent construction of a septic system of adequate size to replace the failing systems. Permit Sonoma Well & Septic Division staff concur with these findings.
Permit Sonoma Comprehensive Planning Division staff have determined that the parcel is located outside, but adjacent to, both the Sonoma Valley County Sanitation District (District), and the Urban Service Area (USA). Staff further determined that the Parcel qualifies for exceptions in accordance with General Plan Policy PF-1F and PF-1g, stating “Where necessary to resolve a public health hazard resulting from existing development”, and that the existing failing septic systems present a public health hazard, and that the Parcel adjoins the USA boundary.
Connection to a public sewer system will mitigate the potential for the septic systems to release pathogens and effluent into potential groundwater sources, and to the surface of the ground. At the time the property is connected to the public sewer system, the existing septic systems shall be abandoned with permits obtained from the Engineering Division of Permit Sonoma.
Approval of the OSAA is required by the District Board of Directors. Following an approval of the OSAA, the applicant will need to submit an application to the Sonoma Local Agency Formation Commission (LAFCO) for review and approval of the agreement. The agreement will not be effective until such LAFCO approval has been obtained.
The applicant will acquire permits and construct a sewer main extension at their own expense, as there is no existing District-owned sewer main located in a District or fee title, or public way immediately contiguous to the parcel to be served. The owner will be required to pay Sewer Connection fees and Annual Service Charges as calculated using the most current fee schedule at the time of payment.
The District’s General Manager has determined that approval of the Agreement is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(b) Existing Facilities, as it represents an additional connection to an existing public facility that involves negligible or no expansion of an existing or former use, and pursuant to 15303(d) New Construction or Conversion of Small Structures, as the project consists of construction of limited new, small sewage improvements of reasonable length to serve the parcel, and pursuant to Section 15304(f), Minor Alterations to Land, as the extension of the main sewerline and connection to the parcel consist of minor trenching where the surface is restored; and that no exceptions listed under Section 15300.2 apply; and there is no possibility that the project would have a significant effect on the environment.
Sonoma Water staff on behalf of the District has prepared a Notice of Exemption for the Agreement in accordance with the CEQA, the State CEQA Guidelines, and the Sonoma Water’s Compliance Procedures for CEQA.
