B) Delegate authority to the Director of Transportation and Public Works to execute amendments to the agreement to extend the contract term for up to two additional years at no additional cost should more time be needed to complete the work.

Executive Summary:
The Hauser Bridge Project completed construction in 2018. A new two-lane bridge (Bridge Number 20C-240) that is 29-foot wide and 165-foot long was constructed on Hauser Bridge Road over the South Fork of the Gualala River. As part of the project, the environmental agencies required plants, trees, and shrubs to be planted for mitigation and required subsequent monitoring and reporting of such planting efforts. Department of Transportation and Public Works (DTPW) advertised a request for proposals (RFP) to solicit proposals for these services and recommends awarding a contract to the highest-ranking proposer - WRA Landscape Restoration, Inc.
Discussion:
Department of Transportation and Public Works (DTPW) requests that the Board approves and authorizes the Chair to execute a five-year Professional Services Agreement (PSA) with WRA Landscape Restoration, Inc. (WRA) for an amount not to exceed $554,588 ($504,171 plus a 10% contingency of $50,417). The scope of work includes mitigation planting, plant establishment work, site irrigation, as well as replanting and erosion repair if necessary. In addition, WRA will be responsible for the overall site monitoring and environmental reporting for a minimum of five years after the initial planting. It is anticipated that Natural Resource Division staff from Permit Sonoma will assist with the oversight of the mitigation planting and monitoring.
The services to be performed under the proposed agreement-with the exception of erosion repairs-are eligible for 100 percent Federally funding, with 88.53% through the Federal Highway Bridge Program and the remaining 11.47% local agency match requirement offset with available Toll Credits. Toll Credits (also known as transportation development credits) are a Federal transportation funding tool that can be utilized by states as a means of meeting local and state matching requirements for Federal funding. State credits are accrued when capital investments are made in Federally-approved toll facilities including toll roads and bridges. These credits can be used as a “soft match”-meaning they do not represent an actual source of funding but reduce the amount of funding a State or local agency has to contribute and allows some projects to be funded with 100% Federal funds versus the traditional 88.53% / 11.47% split between Federal and State/local funding sources. DTPW has requested reimbursement for entire contract amount; however, Caltrans has only approved $320,653 to date. In the event Caltrans fails to approve additional funding, the County will need to pay for the balance of contract costs ($233,935) from other Roads Fund sources.
DTPW initially advertised the RFP from August 31 to September 28, 2021 but no proposals were submitted. DTPW advertised the RFP again from October 12 to November 9, 2021 and proposals from Pacific Watershed Associates, Hanford ARC and WRA Landscape Restoration, Inc. were received. After careful evaluation by DTPW staff, WRA Landscape Restoration Inc. was selected as the highest-ranking proposer. WRA Landscape Restoration Inc. has experience performing similar planting and restoration work with municipal agencies, and exceeded the Disadvantaged Business Enterprise (DBE) goal for this RFP. DTPW recommends awarding an agreement with WRA Landscape Restoration, Inc. for the Hauser Bridge Mitigation and Monitoring project. Failure to award this contract and/or complete the required environmental mitigation work could result in the County returning all Federal funding received for this project to date.
Strategic Plan:
This is the final phase of the Hauser Bridge Replacement Project. Construction of the replacement bridge was completed in 2018; however, the County is required by State and Federal environmental permitting agencies to restore riparian habitat impacted by the bridge construction.
This item directly supports the County’s Five-year Strategic Plan and is aligned with the following pillar, goal, and objective.

Narrative Explanation of Fiscal Impacts:
Appropriations for this agreement are included in the FY 2021-22 Roads Division Maintenance (11051-34010102) budget and will be requested in future Roads Division annual budgets. Estimated fiscal year breakdown of costs is detailed above, including contingency. TPW has applied for 100% reimbursement from Caltrans (88.53% through the Highway Bridge Program with the 11.47% local match requirement offset from available Toll Credits) for this project; however, Caltrans has only approved $320,653 to date. In the event Caltrans does not approve additional funding, DTPW will utilize traditional Road Maintenance funding sources including the State Highway Users Tax (HUTA), and the Road Maintenance and Rehabilitation Act (SB1) to cover the remaining $233,935 in expenses.
