Authorize Sonoma County Water Agency’s General Manager to execute the First Amended and Restated Agreement for Review of Development Improvement Plans for Flood and Drainage with Coastland Civil Engineering, LLP, in a form approved by County Counsel. The amended agreement expands the payment section to allow an annual rate increase to continue the work, with no change to agreement’s not to exceed amount or end date of October 31, 2025.

Executive Summary:
Coastland Civil Engineering, LLP (previously Coastland Civil Engineering, Inc.) (Consultant) has been reviewing developers’ improvement plans, calculations, and transmittal letter submissions for drainage and flood control design and compliance with the Sonoma County Water Agency Flood Management Design Manual (Design Manual). Consultant’s rates have increased since the work began in November 2022. Under the amended agreement, Consultant will be paid its current rates.

HISTORY OF ITEM/BACKGROUND
Sonoma County Water Agency (Sonoma Water) provides drainage review services to the cities of Santa Rosa, Rohnert Park, Cotati, Sonoma, Petaluma, Cloverdale, and the Town of Windsor. Sonoma Water’s responsibilities for drainage review services are limited to reviewing plans, calculations, and transmittal letter submissions for drainage and flood control design, and for compliance with the Design Manual and drainage master plans.
The Design Manual is used to guide public agencies and private entities in Sonoma County that are planning, designing, constructing, or maintaining waterways, channels, closed conduits, or culverts. The Design Manual provides methods and criteria for analyzing storm drain systems and facilities that are necessary to convey rainfall run-off due to large storm events.
Review services are needed to provide timely support for the numerous commercial and residential development projects that are submitted to Sonoma Water by agencies and to avoid delays caused by backlog.
Sonoma Water and Consultant entered into an agreement for engineering review of development improvement plans for flood and drainage, dated November 2, 2022, in the amount of $300,000.
SELECTION PROCESS
Consultant was selected from a list of qualified consultants developed from a competitive selection process. Attached is a memorandum that explains the competitive selection process.
Consultant was selected for the subject work because Consultant is familiar with the Design Manual and has provided quality work for Sonoma Water. In addition, Consultant does not design private developments in Sonoma County, therefore, there is no conflict of interest in providing services for Sonoma Water.
SERVICES TO BE PERFORMED
Under the amended agreement, Consultant will continue to review developers’ improvement plans, calculations, and transmittal letter submissions for compliance with the Design Manual.
There is no change to the not-to-exceed amount of $300,000, and no change to the end date of October 31, 2025.
Board approval is necessary for this amended agreement to allow Consultant to increase hourly rates. Typically, the Sonoma Water negotiates appropriate rate increases over the term of a multi-yar agreement, consistent with typically market rates. This was, however, inadvertently left out of this contract by Sonoma Water and Consultant. The address cost increases experience by Consultant, Sonoma Water recommends this contract be amended to include typical market rate increases.
