The recommended resolution will authorize annexation of 840 and 845 Horn Avenue, in Glen Ellen to the Sonoma Valley County Sanitation District.
Discussion:
Bear Flag Engineering, Inc. (Applicant), on behalf of parcel owner Melodee J. Vandeman, as Trustee of FRANCES M. GEMINI SURVIVOR’S TRUST of THE GEMINI FAMILY TRUST, has requested via application to County of Sonoma, Permit Sonoma that APN 054-270-015 and APN 054-270-018 or any succeeding resultant parcels (Parcels) be annexed into the Sonoma Valley County Sanitation District (District).
A Lot Line Adjustment, LLA23-0012, between APNs 054-270-015 and 054-270-018 is in concurrent review and may be approved before or after the annexation to the District is approved. Applicant is considering an Administrative Certificate of Compliance (ACC) to create 3 parcels from APN 054-270-018 although this application has not been received by Permit Sonoma.
APN 054-270-015 consists of a single-family dwelling, addressed as 840 Horn Avenue with three (3) accessory structures. APN 054-270-018 consists of five (5) single-family dwellings with two (2) detached garages and is addressed as 845 Horn Avenue.
The District has determined that there is sufficient sewer system (mains, manholes, trunk lines, etc.) capacity for connection of the existing dwellings.
Provided annexation is granted, all existing septic tanks shall be decommissioned in accordance with Permit Sonoma Well and Septic Division’s Septic Tank Destruction Permits, and Septic Tank Destruction Requirements, therein. Tank destruct permits shall be issued by Permit Sonoma for abandonment of the existing septic systems. Abandonment of each septic system shall occur at the time of connection to the sewer system and shall be observed and approved by an Inspector from the Permit Sonoma Engineering Division.
Permit Sonoma, Planning Staff has determined the Parcels are located within the eastern boundary of the Urban Service Area of the unincorporated community of Glen Ellen and are consistent with Sonoma County General Plan Goals LU-2, LU-3 and Policies LU-3c and PF-1f.
The District’s General Manager has determined that approval of the resolution in support of annexation is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(b), Existing Facilities, as it represents an additional connection to an existing public facility that involves negligible or no expansion of an existing or former use, and Section 15303(d), New Construction or Conversion of Small Structures, as it consists of construction of limited new, small sewage improvement of reasonable length to serve the parcels.
The Owner shall apply to the Local Agency Formation Commission (LAFCO) for review and approval of the annexation of Parcels to the District, and LAFCO intends to add the Parcels pursuant to requirements of the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000.
Annexation of Parcels will not be effective until it has been approved by LAFCO and a LAFCO Certificate of Completion has been recorded with the Sonoma County Recorder’s Office. Owner must pay sewer connection and service fees required for all uses on the Parcels based on the current method of calculations per District Ordinances in effect at the time of connection to sewer.
