Recommended Action:

Recommended action

Authorize the Clerk of the Board to publish notice of intent to execute a Fourth Amendment to a Lease with 3725 Westwind SR LLC, as Landlord, for 17,866 square feet of office space at 3725 Westwind Blvd, Suite 200, Santa Rosa.

end

Executive Summary:

The Director of Public Infrastructure, in consultation with the Department of Child Support Services, requests authorization to publish a notice of the Board’s intent to execute a Fourth Amendment to a Lease with 3725 Westwind SR LLC for the Department of Child Support Services use of 17,866 square feet of office space at 3725 Westwind Blvd, Suite 200, Santa Rosa.

If approved, the proposed amendment would extend the existing lease term for five years, at an initial monthly rent of $34,838.70 ($1.95 per square foot). Rent would increase 3% per year for the remainder of the lease term, and the County would retain the right to terminate the lease, with or without cause, upon 180 days’ written notice. Public Infrastructure and Child Support Services recommend approving the amendment as Board approval of the Lease will enable the Department of Child Support Services to avoid relocation costs and service disruptions, achieve a decrease in rent, and receive tenant improvements paid and provided by the landlord.

Discussion:

The Department of Child Support Services (“DCSS”) has occupied 17,866 square feet of office space at 3725 Westwind Blvd, Suite 200, Santa Rosa since 2010. The existing lease is set to expire May 30, 2027. DCSS, supported by the Sonoma County Public Infrastructure Department, initiated lease extension discussions with the Landlord (3725 Westwind RE LLC) in June 2026, to avoid relocation costs and service disruptions, reduce rent, and receive tenant improvements provided and paid for by the Landlord. Negotiations continued through September 2026 and resulted in the proposed Fourth Amendment.

Lease Amendment.

The proposed Fourth Amendment between 3725 Westwind SR LLC, as Landlord, and the County of Sonoma, as Tenant, contains the following key provisions:

1.                     Five-year lease extension from June 1, 2027, through May 30, 2032;

2.                     Initial monthly rent of $34,838.70 ($1.95 per square foot), a 6.67% rent reduction from the previous year’s rent;

3.                     3% annual rent increases;

4.                     Landlord, at Landlord’s sole expense, shall provide new carpet and paint throughout the premises prior to commencement of the extension term;

5.                     County has responsibility for utilities in addition to rent; and

6.                     All other terms of the existing Lease remain unchanged, including County’s right to terminate, with or without cause, upon 180 days written notice.

Project Costs and Construction Schedule.

All improvements to be completed by Landlord at Landlord’s sole expense prior to commencement of the extension term.

Procedural Authority. Government Code Section 25350 requires the County to publish notice of the Board’s intent to enter into a lease or lease amendment valued at more than $50,000 for three successive weeks prior to execution. If the Board approves the recommended action, the proposed amendment will return to the Board on or after December 8, 2026, for consideration and approval.
