The recommended resolution will authorize the General Manager of Sonoma Water to execute an Outside Service Area Agreement on behalf of the Sonoma Valley County Sanitation District with the property owners Benjamin Cabie and Maria Cabie, Husband and Wife, As Joint Tenants; and Richard Hire, an unmarried man, for public sewer service to property located at Assessor Parcel Number (APN) 052-451-009 on 805 Petaluma Avenue in Sonoma.
Discussion:
The Sonoma County Permit and Resource Management Department (Permit Sonoma) received an application for an Outside Service Area Agreement (Agreement) to provide public sewer service to property located at 805 Petaluma Avenue, Sonoma, California. Bear Flag Engineering, Inc. submitted the application on behalf of the property owners, Benjamin Cabie and Marie Cabie, Husband and Wife, As Joint Tenants; and Richard Hire, an Unmarried Man (Owner).
The proposed Agreement would allow the Sonoma Valley County Sanitation District (District) to provide public sewer service to this parcel within its Sphere of Influence. This service is subject to and consistent with the requirements of and authorized by the Sonoma County Policy PF-1f, as it would resolve a public health hazard. Furthermore, the project meets the guidelines of Policy PF-1g, therefore, the proposed project is consistent with the Sonoma County General Plan, and allows the single-family residence, currently used as a residential care facility with 12 beds, to be connected to the public sewer.
805 Petaluma Avenue has a failing septic system as determined by Permit Sonoma, Well & Septic Division staff’s approval of a findings report by Bear Flag Engineer, Inc., dated 12/28/2021. Based on the findings there is no feasible or potential area for a code-compliant septic system on the property, and the failing septic system shall be abandoned when the existing single-family dwelling is connected to public sewer.
805 Petaluma Avenue (APN 052-451-009) is a 0.58 acres residential parcel. The property access is off of Linden Street, which borders the southerly easterly line. The property has an existing single-family residence, currently used as a residential care facility with 12 beds, a barn, several outbuildings, is generally flat, and is covered by grasses, shrubs and trees.
The residential care facility requires 6.84 Equivalent Single-Family Dwelling billing units (ESD). Sonoma Water staff, which operates the District under contract, has determined that there is currently adequate capacity available in the District’s sewerage facilities, the sewage treatment facilities, and the treated effluent disposal system, to accommodate the 6.84 ESD.
Sonoma Water staff has determined that a direct sewer lateral connection shall be made to a new sewer main extension westerly from the existing sewer manhole located in Petaluma Avenue, easterly of the Linden Street intersection, such that the main is adjacent to Parcel, in Petaluma Avenue, and a direct side sewer connection to this proposed main of the single-family dwelling. Owner may construct other sewer main extension alignments in conformance with District Sanitation Code with approval by Sonoma Water.
The Owner shall pay Sewer Connection fees, as they are calculated using the most current fee schedule at the time of permitting, and Annual Service Charges to the District for sewer service to the property for the property’s uses.
Following approval of the Agreement by the District’s Board of Directors, the Owner shall complete a Local Agency Formation Commission (LAFCO) application for Permit Sonoma’s review and submittal to LAFCO. The Owner shall include with the application, payment of all required LAFCO fees. The Agreement shall not be effective until such time as it has been approved by LAFCO.
Sonoma Water’s General Manager, on behalf of the District, has determined that approval of the Agreement is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301(b), Existing Facilities, as it represents an additional connection to an existing public facility that involves negligible or no expansion of an existing or former use, and Section 15303(d), New Construction or Conversion of Small Structures, as it consists of construction of limited new, small sewage improvement of reasonable length to serve the parcel. Sonoma Water staff has prepared a Notice of Exemption in accordance with the CEQA, the State CEQA Guidelines and the District’s Procedures for the Implementation of CEQA, on behalf of the District.
