Executive Summary:

The canvass for the March 3, 2020 Presidential Primary Election has been completed and certified by the County Clerk. The Clerk is now submitting the official canvass to the Board of Supervisors for adoption as provided by law.

 

Discussion:

Pursuant to Elections Code §1000, the Presidential Primary Election was held on March 3, 2020. The results thereof have been certified by the County Clerk, and the certification must be adopted by the Board of Supervisors as the governing body. Elections Code Section §15372 provides that the Clerk shall canvass the returns and certify results to the Secretary of State’s Office within 30 days following the election. Following certification of the official results to the Secretary of State, Elections Code Section §15302 requires the Clerk to submit a certified statement of the results to the governing body (the Board of Supervisors) for adoption. The canvass has been completed, and the Statement of the Votes Cast, on file with the Clerk of the Board, is submitted to the Board for adoption as provided by law. The Board shall, pursuant to Elections Code §15400, declare elected to each office voted on at each election under its jurisdiction, the person having the highest number of votes for that office, or the person who was elected or nominated under the exceptions noted in §15452. The official canvass is also transmitted to the appropriate special districts for adoption by their governing bodies. Final results will also be reported to the Secretary of State as required for state-certified contests.
